CHAPTER 348.

AN ACT to add one new section to Article 1 of the Code of
Public Local Laws of Maryland (1930 Edition), title "Alle-
gany County, " sub-title "County Commissioners, " to her
known as Section 105A, empowering the County Commis-
sioners of Allegany County to sell or lease the property, or
any part thereof, situated on the northerly side of Wash-
ington Street in the City of Cumberland, Allegany County,,
Maryland, and known as the "Academy Property" and the
"Old Jail House. "

SECTION 1. Be it enacted by the General Assembly of
Maryland, That one new section be and the same is. hereby
added to Article 1 of the Code of Public Local Laws of Mary-
land (1930 Edition), title "Allegany County, " sub-title
"County Commissioners, " to be known as Section 105A, and
to read as follows:

105A. The County Commissioners of Allegany County are
hereby authorized and empowered to sell and convey by a good:
and sufficient deed or to lease the county property or any part
thereof situated on the northerly side of Washington Street
in the City of Cumberland, Allegany County, Maryland, and
known as the "Academy Property" and the "Old Jail House, "

upon such terms as shall be most advantageous to Allegany
County, but in no event shall the whole or any part of said'
property be sold for less than a reasonable and fair sum, and
no sale or lease for a period of more than two years, of the
same, shall be valid until ratified and approved by the Judges
of the Circuit Court for the Fourth Judicial Circuit of Mary-
land, and in no event shall the "Academy Property" be sold1
for use other than an educational institution; and any deed
conveying the same must contain a covenant running with
the land prohibiting the use of the same for purposes other
than educational.

SEC. 2. And be it further enacted, That this Section shall!
take effect on the first day of June, 1931.
