Hyattsville shall determine it to be necessary for the public
benefit that any of said unaccepted streets, avenues, roads or
alleys should be taken over by it, it shall take supervision and
control of the same and do such repair and construction work
therein as it may deem proper.

The said Mayor and Common Council may, after it shall
have determined it to be necessary for the public benefit, con-
struct therein sidewalks, curbs, gutters and roadbed and street
improvements (which improvements may be constructed all
at the same time or at different times), and after the comple-
tion of said improvements, or any of them, it shall assess the
costs thereof upon the land abutting the same in accordance
with Section 540A of this Article.

SEC. 2. And be it further enacted. That all Acts or parts
of Acts of any Public General or Public Local Laws incon-
sistent with the provisions of this Act be, and the same are
hereby, repealed to the extent of such inconsistency.

SEC. 3. And be it further enacted, That should any section
or part thereof of this Act be declared unconstitutional, the
said section or part thereof shall be deemed and taken to be
severable from the balance of said Act and all the balance of
said section or parts of sections and all the balance of said Act
shall be and remain as a valid and subsisting Act,

SEC. 4. And be it further enacted, That the provisions of
this Act shall not become effective until the same shall be sub-
mitted to and approved by the qualified voters of the town of
Hyattsville, as hereinafter provided.

The said election shall be held in conjunction with the next
general election of the town of Hyattsville held after the pas-
sage of this Act, or, in the discretion of the Mayor and Com-
mon Council of Hyattsville such election may be held as a
special election to be held within three months after the pas-
sage of this Act, which special election shall be conducted in
all respects as general elections of the town of Hyattsville are
conducted; provided, that in the event of either general or
special election a copy of this Act be published in some news-
paper published in the town, of Hyattsville at least ten days
before the date of such election.

The ballots shall be prepared as ballots are prepared for a
general election and shall have printed thereon the words "For
Improvement of Streets Amendments" and immediately there-
