ner and no other shall appointments be made for the position
of police officer in said city.
21C. The Police Commissioner shall have and exercise full
control and dominion over the police of said city, having the
power to make such rules and regulations governing them as
he, from time to time may prescribe, and to remove, reprimand,.
or suspend any person guilty of any infraction or other viola-
tion of such rules or regulations, and he shall have the power
to promote, reduce in rank, or dismiss any police officer, pro-
vided that in case of dismissal or any case which in his judg-
ment warrants dismissal, the charges and specifications in
writing shall be drawn and served on the police officer at least
five days before a trial, and reserving to the said police officer
the right to be represented by counsel or attorney at the said
trial or. hearing, and, if the judgment of the said Commis-
sioner, the case warrants a dismissal, he shall dismiss said
officer. The said Commissioner shall not appoint, promote,,
reduce in rank, or remove any police officer from the said serv-
ice for any political affiliations or because of any religious be-
lief or for any other cause other than the fitness or unfitness
of such person for the position which he occupies, both morally
and physically.
21D. A member of the Police Department may be retired
from the Department after twenty years of active service on a
retirement salary of $50. 00 per month, if permanently inca-
pacitated for active duty, in the opinion of the Commissioner,,
and may be retired at any time if permanently incapacitated
on account of injuries received in the performance of duty.
It shall be mandatory upon the Mayor, Counselor and Alder-
men to appropriate and levy each year a sufficient sum to pay
the pensions herein provided for to all members of the Police
Department retired under the provisions of this section. There
shall be no provisions in the law under which a member of the
Police Department may apply for retirement or be retired at a
certain age limit.
SEC. 2. And be it further enacted, That all general or local
laws, or parts of such, inconsistent with the provisions of this
Act, shall be, and they are hereby repealed.
SEC. 3. And be it further enacted, That this Act shall take
effect June 1, 1931.
