department be killed, or dies from natural cause, or injury,
then the amount of his contribution to the fund herein pro-
vided shall be refunded to his. nearest relative, but if any
member has received a monthly pension, no refund of his con-
tribution shall be made.
21 A. There shall be appointed biennially by the Mayor,
Counselor and Aldermen of the City of Annapolis a discreet
person, a resident of or engaged in business in said City of
Annapolis for three (3) consecutive years next preceding the
date of his appointment, who shall be styled the Police Com-
missioner of the City of Annapolis, and his term of office shall
be for a period of two years and until his successor is ap-
pointed and qualified. He shall be subject to removal by the
Governor of Maryland for official misconduct or incompetency,
provided that he shall be served with a copy of the charges and
specifications, in writing, at least five clays before a hearing
thereon shall be had. The said Commissioner shall not be
eligible to an elective office during the term for which he was
appointed, and for the first two years the Commissioner shall
be R. Lee Waller, who shall serve as such Commissioner with-
out pay until the expiration of his term, after which time the
Mayor, Counselor and Aldermen of the City of Annapolis shall
appoint as aforesaid and shall pay a salary to the said Com-
missioner not exceeding the sum of two hundred dollars
($200. 00) per annum. There shall be appropriated each year
one hundred and fifty dollars as a contingent fund for the said
Police Commissioner to be expended for traveling expenses
or for such other purposes as said commissioner may, in his
discretion, deem desirable and said fund shall be paid by the
Treasurer of the City of Annapolis upon the order of the said
Police Commissioner without the approval of any other official
or officials, anything in the Charter or ordinances of said City
to the contrary notwithstanding.
2IB. All applications for appointment as a member of the
police force in the City of Annapolis shall be filed with the
said Commissioner, and it shall be the duty of the Police Com-
missioner to make out a list of all applicants for the positions
in. said department, grading them according to the examina-
tion in which he shall test, the moral, mental, physical and
educational qualifications and, from the eligible list, the said
Commissioner shall choose one of the three having the highest
rating for the said vacancy or appointment, and in this man-
