forthwith reported to the said County Commissioners for their
final action and control; and said County Commissioners shall
have the right to require said Engineer to endorse his recom-
mendation upon any and all bills growing out of any contract
performed under his supervision before paying the same.
Neither the said Engineer nor any assistant shall have any
pecuniary interest in any contract entered into by the County
Commissioners or on behalf of said county. For all streets,
road, alley, sidewalk, curb, gutter, drain or any public work
in said county the payment for which is or shall be based
either in whole or in part upon a special assessment or front
foot benefit assessment plan the said County Commissioners
shall cause said Engineer to make a reasonable charge for all
work performed by him or his assistants in the preparation
of plans, specifications and estimates for, and inspection on
said work, which said charge shall be fairly comparable to the
usual and customary charges made by engineers for similar
work, and shall add said charge to the cost of construction or
repair on any such project, and the money representing the.
charge for such engineering work, when collected shall be
placed in the County Treasury in a special fund to be desig-
nated as "Engineering Department Fund" and in addition to
said funds the County Commissioners are hereby authorized,
directed and empowered to levy, against all the assessable prop-
erty in Montgomery County such sum or sums as they may in
each year deem necessary for the maintenance of a County
Engineering Department, which moneys shall be placed in the
County Treasury to the credit of the "Engineering Depart-
ment Fund, " and out of the said fund herein provided the
County Commissioners are hereby authorized and empowered
to pay all salaries and expenses necessary and incident to the
establishment and maintenance of a Department of Engineer-
ing as herein provided; and provided further that any moneys
remaining in the said fund at the end of any fiscal year may
be expended by the County Commissioners for general County
purposes; and provided that neither the County Engineer nor
any assistant shall receive from Montgomery County any com-
pensation by way of fee or otherwise, other than such annual
salary, payable in monthly installments, as the County Com-
missioners may from time to time provide; and provided
further that the said County Commissioners are hereby au-
thorized and empowered to make such rules and regulations
as they may from time to time deem necessary for the mainte-
