ized by Chapter No. 193 of the Acts of the General Assembly
of Maryland, Session of 1929, as Section 755, be and the same
is hereby repealed and re-enacted so as to read as follows:
457. The County Commissioners of Montgomery County
are authorized and directed after the passage of this Act, to
appoint some person duly qualified as a competent Roads
Engineer, to perform the duties of County Engineer, deter-
mine the amount of bond which he shall give, fix his compensa-
tion; arrange for the appointment of such assistants as they
may from time to time deem necessary, fix the compensation
of such assistants; remove said Engineer and/or assistants,
whenever in their judgment, it is necessary for the public
interest; and upon the death, resignation or removal of said
Engineer to appoint a successor with the same rights and
duties. The County Engineer shall inspect all roads, streets,
bridges, sidewalks, alleys, curbs, gutters and drains in each
district of the county as often as may be necessary to properly
maintain them in a safe and proper condition; and shall in-
spect any and all buildings occupied, owned or leased by or
for the use of the county and shall from time to time as may
be necessary or may be required by the County Commissioners
make such general or special examination of any road, street^
bridge, sidewalk, curb, gutter, drain, alley or building as may
be required by said Commissioners; he shall prepare and sub-
mit plans and specifications, and make estimates for the con-
struction, repair, improvement, or any public work in, on or
upon any road, street, bridge, sidewalk, curb, gutter, drain,,
alley or building authorized or proposed by said County Com-
missioners; he shall inspect and report on all material to be
used on any public work as above set forth and shall further
supervise, inspect and/or direct as the agent of the said
County Commissioners all work upon any of the public works
herein above set forth and shall see that all contracts in
reference thereto are faithfully performed and executed; he
shall, when requested by said Commissioners, give instructions
to the foremen or other persons in charge of any repair work
as to the proper location of said repairs, and the manner in
which the work shall be performed, and shall assist the said
County Commissioners in any other manner they may re-
quire; he shall have full power to suspend work being done
under contract if the same is not, in his judgment, being done
in accordance with the terms of the contract or in a manner
contrary to the public interest, his action in this respect to be
