Assembly, the same shall take effect from the date of its-
passage.

CHAPTER 109.

AN ACT to repeal and re-enact, with amendments, Sections
327, 328 and 329 of Article 16 of the Code of Public Local
Laws of Maryland (1930 Edition), title "Montgomery
County, " sub-title "Foxes, " relating to the hunting and kill-
ing of foxes in said county.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That Sections 327, 328 and 329 of Article 16 of
the Code of Public Local Laws of Maryland (1930 Edition),
title "Montgomery County, " sub-title "Foxes, " are hereby re-
pealed and re-enacted, with amendments, to read as follows:

327.     It shall be unlawful for any person to shoot, shoot at,
injure or kill any fox while such fox is being pursued by dogs,,
or to shoot or molest any dog while chasing or trailing a fox, or
to dig out or in any manner take from any den a female fox or
her young whelps or to kill or in any manner cause the death
of such female fox or her young whelps during the period she
is suckling them. Any person or persons violating the provi-
sions of this section shall be deemed guilty of a misdemeanor,
and upon conviction thereof before a Justice of the Peace shall
be fined not less than ten dollars nor more than twenty: five
dollars for each and every offense, and be imprisoned in the
County Jail until the fine and costs be fully paid, all of said
fine to be paid to the County Commissioners for the benefit
of the Public Schools; provided, however, such imprisonment
shall not exceed ten days for each offense.

328.     It shall be unlawful to set any trap of any kind what-
soever within thirty (30) yards of any fox den.

329.     It shall be unlawful to trap, hunt or chase with dog
or gun any fox, between the first day of May and the fifteenth
day of July, inclusive, in each year; provided nothing in this.
