182                         LAWS OF MARYLAND.                 [CH. 101

Councilman so appointed shall be vested with all powers, and
shall perform all the duties of Mayor during such absence or
sickness, and shall receive the salary of the said Mayor during
such vacancy; provided, that if such disability continue ten
days or longer, during such absence in excess of ten days the
Mayor shall receive no salary; provided, further, that the
Councilman receiving compensation as Acting Mayor shall not
receive his salary as Councilman for the same time he receives
compensation as Acting Mayor.

At all meetings of the Mayor and Council, the Mayor and
two Councilmen shall constitute a quorum, or in the absence of
the Mayor, three Councilmen, present and voting shall consti-
tute a quorum for the transaction of business, and three affirma-
tive votes shall be necessary for the passage of an ordinance,
law, resolution or measure of any description at all times.
Upon every vote the yeas and nays shall be called and re-
corded.

98.      The Mayor and Council shall be vested with the power
and charged with the duty of making all laws or ordinances
not inconsistent with the Constitution and Laws of the State,
touching every object, matter and subject within the local gov-
ernment instituted by this Act.

Every ordinance imposing any penalty, fine, imprisonment
or forfeiture for a violation of its provisions shall, after the
passage thereof, be published in one or more newspapers pub-
lished in said town for three (3) successive issues. Ordinances
passed by the Mayor and Council and requiring publication
shall take effect and be in force from and after the date of
their passage, unless it shall therein otherwise expressly be
provided.

The style of all ordinances shall be, "Be it ordained by the
Mayor and Council of Chestertown, " but such caption may be
omitted when said ordinances are published in book form
under the order of the Mayor and Council.

The absence of any Councilman from three regular consecu-
tive meetings of the Mayor and Council, without excuse, shall
constitute a vacancy and all vacancies occurring for this reason
shall be filled as herein provided.

99.      The Mayor and Council shall meet on the first Monday
night in August, 1931, and the first Monday night in April,
1933, and on the first Monday night in April every second
year thereafter to qualify and organize. The Mayor and
