CHAPTER 100-

AN ACT to repeal and re-enact with amendments Sections 1 to
11 inclusive of Article 16 of the Code of Public Local Laws
of Maryland (1930 Edition), title "Montgomery County, "

sub-title "Alta Vista, " for the purpose of abolishing the
special taxing area of Alta Vista, except for the purpose of
authorizing the Treasurer of Montgomery County to collect
all special assessments outstanding at the date of the passage
of this Act and to pay same over to the Treasurer of the vil-
lage of Alta Vista for application to the balance of an indebted-
ness incurred by the Citizens' Committee of Alta Vista; and to
provide for the passage of this Act as an emergency measure.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Sections 1 to 11 inclusive of Article 16 of the Code
of Public Local Laws of Maryland (1930 Edition), title "Mont-
gomery County, " sub-title "Alta Vista, " be and the same are
hereby repealed; provided that for the purpose of collecting
the special assessments heretofore levied by the Citizens' Com-
mittee of the village of Alta Vista upon the approval of the
Board of County Commissioners for Montgomery County, the
Treasurer of Montgomery County be and he is hereby author-
ized and empowered to receive payments on account of said
special assessments as heretofore provided and is further au-
thorized and empowered to collect said special assessments as
county taxes in said Montgomery County are collected, and to
pay over to the Treasurer of the village of Alta Vista the pro-
ceeds of said special assessments (or to his successor to be ap-
pointed by the Citizen's Committee of the village of Alta Vista
in the case of the death, resignation or other inability of the
said Treasurer to act), who shall devote such funds to the ex-
elusive purpose of paying for the special improvements hereto-
fore made by reason of said special assessments, or for the pur-
pose of defraying and liquidating any indebtedness heretofore
incurred by the Citizens' Committee of the village of Alta Vista,
provided that any surplus derived from said special assessments
over and above the amounts hereinbefore authorized may be ex-
pended by the Citizens' Committee of the village of Alta Vista
holding office at the date of the passage of this Act, or the sur-
viving member or members of said Committee, for the improve-
ment of the streets or sidewalks in said village; or for the gen-
eral welfare of residents and taxpayers of said village; and pro-
vided further, that any and all special assessments heretofore
levied on the property in said village of Alta Vista shall be and
remain a lien and retain the same priorities against the prop-
erty upon which said levy was assessed as heretofore, until the
full amount of said special assessment shall have been paid.
