ville and Georgetown Pike, otherwise known as Wisconsin
Avenue, for the purpose of changing the grade of such rail-
way track and for the purpose of removing the trolley poles
from the present location to a new location to be established by
said County Commissioners, and to empower the County
Commissioners to condemn for the purposes of this Act any
and all rights, title and interests claimed or possessed by said
railway company or any other railway company in and to the
Rockville and Georgetown Pike or Wisconsin Avenue.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 2 of Chapter 391 of the Acts of the General
Assembly of Maryland of 1922 be and the same is hereby re-
pealed and the said Section 2 of said Chapter 391 be and the same
is hereby re-enacted with amendments, to read as follows:

SEC. 2. And be it further enacted, That the said County Com-
missioners in their discretion may condemn or cause to be con-
demned such land and premises as may be necessary for the
purpose of widening, improving and maintaining said thorough-
fare along the lines indicated; that said road may be widened,
located or relocated by said Commissioners under the provisions
of the General Laws of Maryland authorizing, requiring and
directing the Commissioners to open, alter, locate or relocate
any public road or by condemnation proceedings as provided for
under the General Laws of this State. That said Commissioners
may, however, accept from the owner of any land adjoining or
abutting said present road such deed or grant of lands as may
be necessary or, may purchase any parcel or strip of land that
may be required to accomplish the widening of the road imme-
diately adjacent thereto and parallel with the boundary line of
said road where the acquisition of said land will gracefully con-
form to the lines of said roadway. That said County Commis-
sioners are further authorized and empowered to exercise the
power to condemn such land and improvements in any special
taxing area or incorporated town or municipality as may be
necessary for the purposes of this Act, and that the said County
Commissioners are further authorized and empowered to enter
into any agreement with the Washington and Rockville Railway
Company of Montgomery County or any company operating
an electric railway system along said Wisconsin Avenue or the
Rockville and Georgetown Pike for the purpose of changing the
grade of its railway tracks so as to conform to the grade of the
street or roadway to be established and for the purpose of re-
moving the trolley poles of any such company from the present
location thereof to a new location to be established by said
County Commissioners; provided all costs incident to any work
within any said electric railway right-of-way shall not be at the
