CHAPTER 394.
AN ACT to add three new sections to Article 39 of the
Annotated Code of Maryland (1929 Supplement), title
"Fish and Fisheries, " sub-title "General Provisions, " said
new sections to be known as Sections 4A, 4B and 4C, and
to follow immediately after Section 4 of said Article, re-
lating to the stocking of certain streams in Garrett
County with fish, making a survey of said streams for the
purpose of preventing pollution and providing for a closed
season for fishing in said streams.
SECTION 1. Be it enacted by the General Assembly of
Maryland, That three new sections be and they are hereby
added to Article 39 of the Annotated Code of Maryland
(1929 Supplement), title "Fish and Fisheries, " sub-title
"General Provisions, " said new sections to be known as
Sections 4A, 4B and 4C, to follow immediately after Section
4 of said Article, and to read as follows:
4A. The Conservation Commissioner is hereby directed
to make a thorough survey of the Youghiogheny River and
its tributaries for the purpose of determining the amount
of pollution in such streams, with a view to eliminating and
preventing such pollution. It shall be the duty of the said
Conservation Commissioner to make periodic tests of the
water in order to detect any possible pollution and to take
whatever steps may be necessary to enforce the present
law against the pollution of streams.
4B. It shall be the duty of the Conservation Commis-
sioner to stock the Youghiogheny River with bass and rain-
bow trout from eight to ten inches in length, from a point
one mile north of Kendall to a point one mile north of Oak-
land, and to stock the larger streams tributary to the
Youghiogheny River between aforementioned points with
brook trout ranging in length from eight to ten inches.
It shall be unlawful to fish in any of said streams for a
period of one year from the time the said Commissioner
stocks them with fish as herein provided, and thereafter the
law regulating the taking of fish in non-tidal waters shall
apply.
4C. The Conservation Commissioner is hereby directed
to pay for the cost of such survey, for the stocking of the
above-mentioned streams with fish, as well as any other
necessary expense incurred in connection with the above-
