796 LAWS OF MARYLAND. [CH. 358

SECTION 1. Be it enacted by the General Assembly of
Maryland, That a new section be and the same is hereby
added to Article 43 of Bagby's Annotated Code of the Public
General Laws of Maryland, Edition of 1924, title "Health, "
sub-title "Commissioners of Pharmacy, " to follow imme-
diately after Section 240, to be known as Section 240 (a),
and to read as follows:

240 (a) It shall be unlawful for any person to sell, dis-
tribute, vend or otherwise dispose of any drug, medicine,
or pharmaceutical or medicinal preparation by means of
any public exhibition, entertainment, performance, or car-
nival, commonly known as "medicine shows" and "patent
medicine shows"; and it shall be unlawful for any person
to throw, cast, deposit, drop, scatter, or leave, or cause to be
thrown, cast, deposited, dropped, scattered or left any pack-
age, parcel or sample of any drug or medicine in or upon
any house, porch, veranda, portico, or any other part of any
house or building or in or upon any lawn, yard or court
without the consent of the owner or occupant thereof, or
upon any street or public highway within this State.

Any person violating any provisions of this section shall
be guilty of a misdemeanor, and, upon conviction, shall be
sentenced to pay a fine not exceeding one hundred ($100)
dollars, and undergo imprisonment not exceeding one (1)
year, or both, or either, at the discretion of the court.

SEC. 2. And be it further enacted, That, if any provi-
sion of this Act, or the application thereof to any person
or circumstances, is held invalid, the remainder of the Act,
and the application of such provision to other persons or
circumstances, shall not be affected thereby.

CHAPTER 358.

AN ACT to repeal and re-enact with amendments Sections
38 and 40 of Article 2B of the Code of Public General
Laws of Maryland, title "Alcoholic Beverages, " sub-titles
"Taxation—Method of Payment" and "Taxation—Penal-
ties for Evasions, " respectively, as the same were enacted
by Chapter 2 of the Acts of the General Assembly of
Maryland at its extraordinary session held in November
and December, 1933.
