tation, investigation, planning, including aesthetic and
structural design, or responsible supervision of construc-
tion, in connection with any private or public buildings,
structures, or projects, or the equipment or utilities thereof,
or the accessories thereto wherein the safeguarding of
life, health or property is concerned or involved, when such
professional service requires the application of the art and
science of construction based upon the principles of mathe-
matics, aesthetics and the physical sciences. Nothing in
this sub-title shall be construed to apply to the principles
of real estate practices, such as appraising, evaluating or
estimating the value of real property in any form.

Section 391. Board of Examiners and Registration of
Architects. The Governor is hereby authorized and directed
to appoint five competent persons, citizens and residents
of the State of Maryland, who shall constitute a Board of
Examiners and Registration of Architects.

Said Board shall be comprised of five members to be
Architects of recognized standing, at least three of whom
shall be graduates of approved schools of Architecture and
all of whom shall have been engaged in the independent
practice of architecture for a period of ten or more years.
The first appointments hereunder shall be made on or
before the first day of July, 1935, upon which date the
term of office shall begin. The term of office of said mem-
bers shall be five years, except that upon the first appoint-
ment one of said members shall be appointed for a term of
one year, one of said members shall be appointed for a
term of two years, one of said members shall be appointed
for a term of three years, one of said members shall be
appointed for a term of four years, and one of said members
shall be appointed for a term of five years, and thereafter
as the term of each member shall expire the Governor shall
appoint his successor for a term of five years, any vacancy
occurring at any time in the personnel of the Board shall
be filled by the Governor's appointing a successor for the
unexpired term. The Governor shall designate as Chairman
of the Board one of the members so appointed by him.
The members of the Board shall receive no salary per diem
and shall be entitled to receive their necessary and proper
expenses for travel and otherwise, out of the monies avail-
able therefor in the hands of the Board. The Board may
appoint, discharge at pleasure, and fix the compensation
of the Secretary and such clerical force as from time to
time in its judgment may be necessary in the administra-
tion of this Act if and when it shall have funds available
