tions, that proportion of the income received by a resident
of this State from such intangible personal property which
the number of non-resident trustees or other fiduciaries
bears to the whole number of trustees or other fiduciaries,
shall be deemed to be derived from such intangible personal
property held by trustees or other fiduciaries not residents
of this State. "

SEC. 3. And be it further enacted, That paragraph (b)
of Section 8 of Article'81 of the Annotated Code of the
Public General Laws of Maryland, title, "Revenue and
Taxes, " sub-title "Ordinary Taxes, " sub-heading "What
Shall Be Taxed and Where" (as amended by Chapter 258
of the Acts of 1931) be and the same is hereby repealed.

SEC. 4. And be it further enacted, That if any part or
provision of this Act, or the application thereof to any per-
son or circumstance should be held invalid, the remainder
of said Act, and the application of such part or provision
thereof to any other persons or circumstances shall not be
affected thereby.

SEC. 5. And be it further enacted. That this Act shall
take effect June 1, 1935.

CHAPTER 303.

AN ACT to create a new article to be added to the Code of
Public General Laws of Maryland, 1924 Edition, to be
known as Article 88-B and to be under a new title to read
as follows: "State Police, " said article to follow immedi-
ately after Article 88-A of the Code of Public General
Laws of Maryland, 1924 Edition, and to contain twenty-
nine sections, to be known as 1, 2, 3, 4, 5, 6, 7, 8, 9, 10,
11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 24, 25, 26,
27, 28 and 29. Said article is for the purpose of creating
a Department of Maryland State Police, providing for a
Superintendent of said Department, granting certain
rights, duties and powers unto said Superintendent pro-
viding for ranks and positions in the Department; for the
payment of the employees of the Department; for the
transfer of employees from the Commissioner of Motor
Vehicles to the Department; for the method of appoint-
