hereby repealed and re-enacted with amendments, to read
as follows:
316. Every person, his counsellors, aiders or abettors,
who shall be convicted of the crime of kidnapping and
forcibly or fraudulently carrying or causing to be carried
out of or within this State any person with intent to have
such person carried out of or within this State, or with the
intent to have such person concealed within the State or
without the State, shall be sentenced to death or to the pen-
itentiary for not more than thirty years, in the discretion
of the Court.
317. Every person, his counsellors, aiders or abettors,
who shall be convicted of kidnapping and forcibly or fraud-
ulently stealing, taking or carrying away any child under
the age of sixteen years shall be sentenced to death or to
the penitentiary for not more than thirty years, in the dis-
cretion of the Court.

CHAPTER 284.
AN ACT to repeal and re-enact with amendments Section
466 of Article 27 of the Annotated Code of Public Gen-
eral Laws of Maryland (1924 Edition), title "Crimes and
Punishments, " sub-title "Rape. "
SECTION 1. Be it enacted by the General Assembly of
Maryland, That Section 466 of Article 27 of the Anno-
tated Code of Public General Laws of Maryland (1924
Edition), title "Crimes and Punishments, " sub-title
"Rape, " be and the same is hereby repealed and re-enacted,
so as to read as follows:
Section 466. Every person convicted of the crime of
rape or as being accessory thereto before the fact shall,
at the discretion of the Court, suffer death, or be sentenced
to confinement in the Penitentiary for the period of his
natural life, or undergo a confinement in the Penitentiary
for not less than eighteen months nor more than twenty-
one years; and penetration shall be evidence of rape, with-
out proof of emission.
