it to any other Justice of the Peace for Baltimore County in
his discretion and provided further that no Justice of the
Peace shall be required to transmit the papers and certified
copy of docket entries hereinabove mentioned until the costs
accruing before him, including Constable costs, be paid.

SEC. 2. And be it further enacted, That all acts or parts
of acts inconsistent herewith, whether general or local are
hereby repealed to the extent of such inconsistency.

SEC. 3. And be it further enacted, That this Act shall
take effect June 1, 1935.

CHAPTER 266.

AN ACT to repeal and re-enact with amendments Section
162 of Offutt's Revised Code of Public Local Laws of
Baltimore County, Edition of 1929, title No. 14 "County
Treasurer" (Flack's Code, 1930, Article 3, Section 162)
substituting a ten per cent (10%) penalty in place and
stead of the present ten per cent (10%) attorney's fee on
delinquent tax bills.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That Section 162 of Offutt's Revised Code of
Public Local Laws of Baltimore County, Edition of 1929,
title No. 14 "County Treasurer" (Flack's Code, 1930, Arti-
cle 3, Section 162), be and the same is hereby repealed and
re-enacted, with amendments, to read £s follows:

Section 162. The Treasurer shall be entitled to the fol-
lowing fees for levying upon property to enforce payment
of taxes: For summoning and swearing two appraisers and
making out a schedule, two dollars and fifty cents, and the
appraisers shall be entitled to fifty cents each; if the prop-
erty be sold, the Treasurer shall receive five per cent, of the
gross amount of sales, with such expenses as may be in-
curred in printing and advertising; but if the amount due
shall be paid without sale, he shall receive four per cent, on
the amount collected, with such expenses as may have been
incurred in making levy, printing and advertising; and
in all cases the party paying shall be entitled to an itemized
