2. When the goods are damaged or deteriorated in qual-
ity, and notice is given to the public thereof.
3. By any officer acting under the orders of any court.
107. Wilfully and knowingly advertising, offering for
sale or selling any commodity at less than the price stipu-
lated in any contract entered into pursuant to the provision
of Section 105, whether the person so advertising, offering
for sale or selling is or is not a party to such contract, is
unfair competition and is actionable at the suit of any
person damaged thereby.
108. This Act shall not apply to any contract or agree-
ment between producers or between wholesalers or between
retailers as to sale or resale prices.
109. This Act may be known and cited as the "Fair
Trade Act. "
SEC. 2. And be it further enacted*, That, if any provi-
sion of this Act, or the application thereof to any person or
circumstances, is held invalid, the remainder of the Act,
and the application of such provision to other persons or
circumstances, shall not be affected thereby.

CHAPTER 213.
AN ACT to repeal and re-enact with amendments Section
73 of Article 5 of the Code of Public Local Laws of Mary-
land (1930 Edition), title "Calvert County, " sub-title
"County Commissioners, " as said section was amended
by Chapter 295 of the Acts of 1933, increasing the com-
pensation of the County Commissioners of Calvert
County.
SECTION 1. Be it enacted by the General Assembly of
Maryland, That Section 73 of Article 5 of the Code of
Public Local Laws of Maryland (1930 Edition), title "Cal-
vert County, " sub-title "County Commissioners, " as said
section was amended by Chapter 295 of the Acts of 1933, be
and it is hereby repealed and re-enacted, with amendments,
to read as follows:
