206. The applicant for a license to sell spirituous or
fermented liquors of any kind whatsoever, shall pay to the
Clerk of the Circuit Court upon the issuing of such license
the sum of one hundred dollars ($100) for one year or
such pro rata part of said sum for a shorter period; pro-
vided, however, that the applicant for a license to sell beer
only either off or on sale shall pay to the Clerk
of the Circuit Court upon issuing of such license,
the sum of Thirty-Five Dollars ($35. 00) for one year or
such pro rata part of said sum for a shorter period. And
any licensee who shall take out said license shall have the
right to sell beer and wine for consumption on or off the
premises and spirituous liquors for consumption off the
premises and in the original containers only. All the funds
received by the Clerk of the Circuit Court under the pro-
visions of this section, less the Clerk's fee and any refunds,
shall be paid over by him to the County Commissioners
of Charles County, and one-half of said funds so received
by the said County Commissioners shall be used by them
in reducing the tax rate required to be levied for the public
schools of said County by the general state law and one-
half thereof shall be used for general county purposes.
Provided, however, that in all cases where the license is for
a place located in an incorporated town, the said license fee
shall be paid by the Clerk of the Court to the Treasurer of
said town, to be used for general town purposes.

Any person violating any of the provisions of this section
shall be punished by a fine not exceeding five hundred
($500) dollars.

207. It shall be unlawful for any licensee under this
sub-title to sell to any minor or habitual drunkard. And
it shall also be unlawful for any licensee under this sub-
title to sell liquors on the Sabbath Day commonly called
Sunday, or any Election Day, nor shall any liquors be sold
by any licensee between the hours of 12 midnight and 6
o'clock A. M. But this section shall not prevent the sale
of any wine, beer or other spirituous or fermented bever-
ages containing less than 8% alcohol by volume, on any
day or at any time. Any person violating any of the pro-
visions of this section shall be deemed guilty of misde-
meanor and upon trial and conviction shall be subjected
to a fine of not less than fifty dollars nor more than
two hundred and fifty dollars, or may be confined in the
County Jail or in the House of Correction for not less than
sixty days; and the Court in its discretion may suppress
the license of any licensee, and no license shall be issued
