CHAPTER 537.
AN ACT to add one new section to Article 89B of the Anno-
tated Code of Maryland (Laws of 1931, Chapter 539),
title "State Roads, " said new section to be known as Sec-
tion 32A and to follow immediately after Section 32,
relating to the construction and maintenance of the high-
way system of the State with funds received from the
United States Government or any agency thereof and
providing for the cost of such project where the funds so
received from the United States Government or any
agency thereof shall be unavailable or insufficient to pay
the total cost of such project, and empowering the State
Roads Commission to eliminate highway hazards, con-
struct or alter railroad or highway underpasses or over-
head bridges agreed upon by the Commission and the rail-
road or railway company, and providing that said section
shall not be a limitation upon the power of the Commis-
sion to require the railroad to contribute its present
statutory apportionment based on the difference between
the total cost of the project and the amount of Federal
funds received.
SECTION 1. Be it enacted by the General Assembly of
Maryland, That one new section be and it is hereby added to
Article 89B of the Annotated Code of Maryland (Laws of
1931, Chapter 539), title "State Roads, " said new section to
be known as Section 32A and to follow immediately after
Section 32 of said Article and to read as follows:
32A. In addition to the powers hereinbefore and herein-
after granted the State Roads Commission is hereby author-
ized to build and improve roads and bridges, including any
and all projects for elimination of highway hazards existing
or found to exist at crossings of highways with railroads,
and including the alteration, reconstruction or relocation of
existing underpasses or overhead bridges, and generally to
construct, improve and maintain the highway system of
this State, with funds received from the United States Gov-
ernment or any agency thereof under such terms and condi-
tions as may be imposed upon the use of said funds; and
for this purpose the State Roads Commission may exercise
any of the powers conferred upon it by this Article or else-
where. The total costs of any project constructed with
funds received from the United States Government or any
agency thereof shall be borne entirely by such funds as far
as the same are available and except insofar as an Act of
