Thousand Dollars with a fidelity or surety company, qualified
to act as surety or guaranty under the laws of the State of
Maryland, as surety, condition that he will well and faith-
fully perform the duties of clerk, treasurer and collector of
taxes in all things according to law and the ordinances of
the city, and that he will account for and pay over all
moneys that may come into his hands as clerk, collector or
treasurer in the manner and as required by law and said
ordinances, provided that he and his surety shall not be re-
sponsible for any losses incurred through the failure or in-
solvency of any depository selected and approved by ordi-
nance or resolution of the Mayor and Council of Salisbury
and in which he shall have duly deposited any funds coming
into his hands by virtue of his office, and provided, further,
that the surety or sureties on his bond shall not be liable
for any loss or losses resulting by reason of the failure of
said clerk, treasurer and collector to collect any portion or
all taxes which may be chargeable to collect by reason of his
appointment as said clerk, treasurer and collector. Said
bond shall be paid for by the Mayor and Council. The said
bond shall be approved by the Council and spread upon its
minutes, and then delivered with the approval endorsed
thereon to the clerk of the Circuit Court for Wicomico
county for record, a certified copy of the same from either
record to be in evidence in any court of this State. If ap-
pointee shall fail or neglect to give satisfactory bond within
fifteen days, unless the time be extended by the Council,
from the date his appointment is confirmed, the Mayor
shall appoint some other person to said office, to be con-
firmed as aforesaid by the Council and to give bond as afore-
said, and said bond to be approved and recorded as afore-
said. In case of a vacancy for any cause in said office, the
Mayor shall appoint some person to fill the unexpired term,
the new appointee to be confirmed and to take the oath as
if originally appointed. The clerk may take the probate to
any account against said city and administer oaths in any
proceedings, where necessary, had before the Council, but
shall receive no fee therefor.
287. At the expiration of the term of his office and the
qualification of his successor the collector shall turn over to
his successor his tax books and all notices and papers con-
nected therewith, together with all money received for
taxes, and the new collector shall succeed to and have all
the powers to collect and enforce the payment of any taxes
so remaining unpaid, as the old collector, and he shall keep
a separate account of such collections.
