(2) Assistance greater than that to which he is justly
entitled;
(3) Payment of any forfeited installment grants; shall
be guilty of a misdemeanor and upon conviction thereof
shall be fined not more than Five Hundred Dollars (500)
or be imprisoned for not more than three months or be
both so fined and imprisoned in the discretion of the Court.
In assessing the penalty the Court shall take into consid-
eration the amount of money fraudulently received.
34. All assistance granted under this Act shall be
deemed to be granted and to be held subject to the provi-
sions of any amendment or repealing Act that may here-
after be passed, and no recipient shall have any claim for
compensation, or otherwise, by reason of his assistance
being affected in any way by any amendment or repealing
act.
SEC. 4. And be it further enacted, That this Act is
hereby declared to be an emergency law and necessary for
the immediate preservation of the public health and safety
and being passed upon a yea and nay vote, supported by
three-fifths of all the members elected to each of the two
Houses of the General Assembly, the same shall take effect
from the date of its passage.

CHAPTER 149.
AN ACT to repeal and re-enact, with amendments, Sec-
tions 1, 3, 5, 6, 8, 11, 13, 15 and 20 of Article 70A of the
Annotated Code of Maryland, 1935 Supplement, title
"Old Age Pensions, " to repeal Sections 16, 17, 18, 19 and
21 of said Article, and to add two new sections to said
Article, to be known as Sections 7 A and 7B, providing
for public assistance to aged persons in need.
SECTION 1. Be it enacted by the General Assembly of
Maryland, That Sections 1, 3, 5, 6, 8, 11, 13, 15 and 20 of
Article 70A of the Annotated Code of Maryland, 1935 Sup-
plement, title "Old Age Pensions, " be, and the same are
