hereby repealed and re-enacted, with amendments to read
as follows:
1. The care and relief of aged persons who are in need
is hereby declared to be a special matter of State concern
and a necessity in promoting the public health and welfare.
To provide such care and relief at public expense, a state-
wide system of relief for the aged, popularly known as
"old age pensions, " is hereby established. Such old age
relief shall be given and administered by the County Wel-
fare Boards created under the provisions of Article 88A
of the Code and by the Department of Welfare of Baltimore
City, subject to partial reimbursement by the State and to
supervision by the Board of State Aid and Charities as pro-
vided in said Article.
3. An old age pension shall be granted to an appli-
cant who:
(1) Has attained the age of sixty-five years or upwards.
(2) Is a citizen of the United States at the time of
making application for a pension.
(3) Has resided in the State for at least five years
within the nine years immediately preceding the date
of application, the last year of which shall be continuous
and immediately precede such application.
(4) Is not an inmate of or being maintained by any
municipal, State or National institution at the time of
receiving a pension. An inmate of an institution may,
however, make application for such pension, but the pen-
sion, if granted, shall not begin until after he ceases to be
an inmate.
(5) Has no child or other person responsible, under
the laws of this State, for his or her support and able
to support him or her; provided that if such child or other
person is partially able to support the applicant, such par-
tial support shall be taken in consideration in fixing the
amount of any pension that may be granted.
5. An applicant for a pension shall file his or her appli-
cation in writing with the Local Board of the County in
which he or she resides or with the Department of Welfare
if a resident of Baltimore City, in such manner and form
as shall be prescribed by the Board of State Aid and Chari-
