be held, unconstitutional by any court of competent juris-
diction, the decision of such court shall not affect or im-
pair any of the remaining provisions.

SEC. 2. And be it further enacted, That this Act shall
take effect June 1, 1936.

CHAPTER 115.

AN ACT to repeal and re-enact with amendments Section
1 of Article 89B of the Annotated Code of Maryland
(1935 Supplement), title "State Roads, " prescribing cer-
tain requirements as to the appointment of members of
the State Roads Commission.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That Section 1 of Article 89B of the Annotated
Code of Maryland (1935 Supplement), title "State Roads, "
be and it is hereby repealed and re-enacted with amend-
ments to read as follows:

1. The head of the Department of Public Works shall
be the State Roads Commission, constituted and organized
as at present, except as hereinafter provided, and haying
and exercising all the rights, powers, duties, obligations
and functions now or hereafter conferred by law. Provided,
however, that on and after May 1, 1939, the State Roads
Commission shall, in addition to the requirements pre-
scribed in Section 1A of this Article, be so constituted that
at all times one member shall be a resident of the Eastern
Shore of Maryland, one a resident of the counties of the
Western Shore of Maryland and one a resident of Balti-
more City.

SEC. 2. And be it further enacted, That this Act shall
be declared to be an emergency law and necessary to the
immediate preservation of the public health and safety,
and being passed by a yea and nay vote, supported by three-
fifths of all the members elected to the two Houses of the
General Assembly, the same shall take effect from the date
of its passage.
