said town. And the person so removed from the office of
town Treasurer shall turn over to the said Commission or
to the Secretary Commissioner any and all funds, money,
property, records, books, papers and other things or thing
of said town in his possession within five (5) days, (in-
cluding Sundays and holidays), after he shall have been
notified of the adoption of such resolution so removing him
from office, which said notice may be served by said Com-
mission either personally by any of said Commissioners,
or by posting of a copy of said resolution at the last regu-
lar meeting place of said Commission at least five (5) days
before the day named in said resolution for him to turn
over the same. Any person, so removed from such office
of town Treasurer, who shall fail or neglect so to turn over
to said Commission, or to the Secretary Commissioner, all
funds, money, property, records, books, papers and other
things or thing of said town in his possession, shall be
liable, and the surety or sureties on his bond shall be liable,
for any loss or damage that said town may suffer thereby,
and said town may institute appropriate proceedings either
at law or in equity for this purpose in the Circuit Court of
Prince George's County, and, in addition to any such pro-
ceedings as aforesaid, said town may institute, in the Cir-
cuit Court of Prince George's County, a mandamus pro-
ceeding against such removed town Treasurer, and thereby
compel such removed town Treasurer to turn over to said
Commission, or to said Secretary Commissioner, all funds,
money, records, books, papers, and other things or thing
of said town. Provided, however, that nothing contained
in this paragraph of this Act shall be construed to limit
said town to the proceedings herein mentioned. And pro-
vided, further, that nothing contained in this paragraph
of this Act shall be construed as relieving any town Treas-
urer or, former town Treasurer from criminal responsi-
bility under any of the criminal laws of the State of
Maryland.

SEC. 4. And be it further enacted, That the Town of
District Heights and The District Heights Commission
shall have power to open, widen, repair, maintain and light
the streets, roads, lanes, alleys, sidewalks and parking of
said town, provided, however, that improvements such as
curbing and sidewalks shall be made at the expense of the
abutting property owner and under regulations prescribed
by the District Heights Commission, or Engineer; to pro-
vide for drainage, sewerage, sanitation, clerical and other
public service, including fire protection, removal of ashes,
