Commission for the purpose of paying for public road im-
provements in Allegany County, and providing for the
method of repaying said notes and interest thereon.
WHEREAS, on the 26th day of April, 1928, the County Com-
missioners of Allegany County and the State Roads Commis-
sion of Maryland entered into an agreement that the said
State Roads Commission should by contract construct and com-
plete a portion of a lateral road in Allegany County, extending
five and one-half miles from a point fourteen miles southwest
of Cumberland to McCoole, and thereunder it was agreed that
the County Commissioners of Allegany County should advance
to the State Roads Commission the sum of One Hundred and
Eighty Thousand ($180, 000) Dollars to be paid by said State
Roads Commission toward the cost of construction of the same,
and that thereafter any and all sums of money which should
be allocated to the County Commissioners of Allegany County
from the "Lateral Road Gasoline Tax Fund, " as provided by
Chapter 117 of the Acts of 1927, and/or from the Post Road
Fund, and/or from any other regular appropriation allotted
to said Allegany County, should be used by said County Com-
missioners of Allegany County for the purpose of repayment
of said sum of One Hundred and Eighty Thousand ($180, -
000. 00) Dollars, and should not be used by said State Roads
Commission for any other lateral road improvements in Alle-
gany County until said sum of One Hundred and Eighty
Thousand ($180, 000. 00) Dollars should be so returned to said
Allegany County, and
WHEREAS, the County Commissioners of Allegany Country,
in order to raise the funds necessary to compensate the State
Roads Commission, agreed to issue notes to the amount of
One Hundred and Eighty Thousand ($180, 000. 00) Dollars,
and
WHEREAS, under said agreement, the said State Roads Com-
mission did enter into a contract for the construction of said
part of said road, and said road is now completed and in use,
and the costs of construction therefor are due and payable to
the contractor, and
WHEREAS, the County Commissioners of Allegany County
are advised that they have 110 authority to issue notes for such
purposes, unless specifically authorized so to do by the General
Assembly of the State of Maryland; now, therefore.
