of the City of Annapolis, after an examination to test the
moral, mental, physical and educational qualifications, an eli-
gible list in order of merit of those applicants accepted, from
which appointments and promotions in the Police and Fire
Departments of Annapolis shall be made and such appoint-
ments and promotions shall be made in no other manner. The
said Committee as herein provided shall proceed under such
rules and regulations as the said Mayor, Counselor and Alder-
men of the City of Annapolis shall hereafter approve.

Section 39-B. All appointments by the Mayor, Counselor
and Aldermen of the City of Annapolis, in said Police and
Fire Departments as provided for in Section 39-A of this Act
shall be on probation for a period of one year after their ap-
pointment and may be dropped by the Mayor, Counselor and
Aldermen of the City of Annapolis, if deemed unsuitable for
the service to which they were appointed. After one year
of service members of the Police or Fire Department may be
removed by the Mayor, Counselor and Aldermen of the City
of Annapolis only for official misconduct, inefficiency, or physi-
cal disability, and before a member may be dismissed for
misconduct or inefficiency, charges in writing must be filed
against him specifying the time, character and place of such
misconduct or the particulars of such inefficiency, and a trial
held before the Committee after five days notice to the accused.

Section 39-C. A member of the Police or Fire Department
may be retired from the Department after twenty years of
active service on a retirement salary of $50. 00 per month, if
permanently incapacitated for active duty, if they contribute
three per centum of their current salary to a Pension Fund.
There shall be no provisions in the law under which a member
of the Police or Fire Department may apply for retirement or
be retired at a certain age limit. In the event that any con-
tributing member of the Department be killed, or dies from
natural cause, or injury, then the amount of his contribution
to the Fund herein provided shall be refunded to his nearest
relative, but if any member has received a monthly pension,
no refund of his contribution shall be made.

Section 39-D. The Mayor, Counselor and Aldermen of the
City of Annapolis are hereby directed and empowered to set
apart out of the taxes collected in the City of Annapolis, such
an amount as is necessary to provide the Pension Fund men-
