named in the foregoing section, the Mayor and Town Council
are hereby authorized and empowered to borrow from time to
time, on the faith and credit of said town, a sum or sums
of money, which shall not, however, in the aggregate at any
one time exceed fifty thousand dollars in amount; and to
issue certificates of indebtedness therefor, which shall be pay-
able within three years from the date of issuance, with inter-

est not to exceed the rate of six per cent, per annum, payable
annually, unless of shorter duration, then at the maturity of
said obligation; and the Treasurer of the Town of Edmonston
is charged with the custody of any moneys received from the
issues of sale of said certificates of indebtedness, as above
mentioned, and with the prompt collection and safe keeping
of the moneys arising from assessments for sidewalks, curbs,
gutters and street improvements, which last said funds shall
be kept as a separate account and fund and no part thereof
shall ever be used for any other purpose than to liquidate
the certificates of indebtedness, and interest thereon, issued
hereunder, which certificates, when paid, shall be cancelled
and properly kept and filed among the papers of said town;
and should the Treasurer of said town ever divert the use
of any of said fund, he shall, upon conviction, be fined not
more than $1, 000 or imprisoned for a term not exceeding
two years, or both fined and imprisoned in the discretion of
the Court.

SEC. 3. When the Mayor and Town Council shall have de-

termined to make sidewalk, curb, gutter or roadbed and street
improvements, or all or any, in any street in said town, they
shall notify, as far as practicable, each property owner upon
said street proposed to be improved, by depositing a notice in
the United States Post Office addressed to such owner's last
known address, setting forth that on a certain day, to be named
therein, the Mayor and Town Council will meet to determine
the character and kind of sidewalk, curb, gutter, roadbed and
street improvement, or any or all, to be laid, and requesting
said owner to appear at said meeting to express his views upon
the matter, if desired. At said meeting the Mayor and Town
Council shall hear any suggestions of said abutting property
owners, and thereafter they shall determine the character and
kind of work to be done and notify the owners in writing of
such determination. The determination of the Mayor and
Town Council shall be final and conclusive as to the kind and
character of said improvements, unless a majority of the own-
