intervenes between arable lands on two adjoining farms shall
not be considered as relieving either of the owners from the
provisions of this section or the other sections of this sub-title,
but either of such owners shall have the right to the remedies
provided in this sub-title if the other party fails or refuses to
comply with the provisions of this sub-title, provided, however,
that whenever a wooded area intervenes, this sub-title shall not
apply unless there is more arable land in each of such adjoin-
ing farms than is in woods.

SEC. 2. And be it further enacted, That this Act shall take
effect June 1, 1924.

CHAPTER 289.

AN ACT to add a new section to Article 39 of the Annotated
Code of Maryland, title, "Fish and Fisheries, " sub-title.
"Potomac, " said new section to be known as Section 59-C
and to follow immediately after Section 59-B of said Article,
prohibiting the use of any beam trawl, trammell net, troll
net or any similar device in the Potomac river or any of its
tributaries.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That a new section be and it is hereby added to Article 39
of the Annotated Code of Maryland, title, "Fish and Fisheries, "
sub-title, "Potomac, " said new section to be known as Section
59-C, to follow immediately after Section 59-B of said Article,
and to read as follows:

59-C. The use of any beam trawl, trammell net, troll net or
any similar device is absolutely prohibited in the waters of the
Potomac river or any of its tributaries. Any person, firm or
corporation violating the provisions of this Section shall on
conviction thereof before any Justice of the Peace of any County
of this State most accessible, forfeit said net or nets, or device,
together with all boats, vessels and tackle used in the violation
of this Section and fined a sum of not less than fifty dollars
and not more than one hundred dollars, or to be subject to both

fine and forfeiture, in the discretion of the Justice of the Peace

trying the case. Provided, however, that nothing in this Act
shall be construed, in any manner, to prohibit the catching of
fish through the method of seine hauling and pound net or gill
