Section 3. And be it further enacted, That the members of
said commission shall be a body corporate, by the name of the
"Anne Arundel County Sanitary Commission, " with the right
to use a common seal, to sue and be sued, and to do any and
all other corporate acts for the purpose of carrying out the pro-
visions of this Act. Whenever it shall be deemed necessary by
said commission to take or acquire any land, structures or
buildings, or any stream bed, water way, water rights or water
shed, either in fee or as an easement, within or without the said
sanitary districts, for the construction, extension or mainte-
nance of any water main, sewer or appurtenance thereof, or
for any sewerage disposal plant, reservoir, water filtration
plant, tank or pumping station, said commission may purchase
the same from the owners or failing to agree with the owner or
owners thereof, may condemn the same by proceedings in the
Circuit Court for the county in which said land, structures or
buildings, stream bed, waterway, water rights or water shed as
now provided for condemnation of land by public service cor-
porations in the Code of Public General Laws of Maryland,
and said commission may likewise condemn the interest of any
tenant, lessee or other person having an interest in said land,
structures or buildings, stream bed, water way, water rights or
water shed.

At any time after ten days after the return and recordation
of the verdict or award in said proceedings, the said commis-
sion may enter and take possession of the property so con-
demned, upon first paying to the Clerk of the Court the amount
of said award and all costs taxed to date, notwithstanding any
appeal or further proceedings upon the part of the defendant;
at the time of said payment, however, it shall give its cor-
porate undertaking to abide by and fulfill any judgment in
such appeal or further proceeding.

Section 4. And be it further enacted, That as soon after
the organization as possible, the said commission shall cause
surveys, plans, specifications and estimates to be made for
water supply, sewerage and drainage systems in those portions
of Anne Arundel County over which they exercise authority,
in its judgment, such system, or any of them are necessary,
and shall divide such territory into water, sewerage or drain-
age districts in such a way as shall, in its judgment, best serve
the needs of the various communities, and shall promote con-
venience and economy of installation and operation. When-
ever and as plans are completed in those districts most needing
