death of the incumbent shall be filled by the remaining mem-
bers of said Commission from among the citizens of Salisbury,
subject to confirmation by the Mayor and Council of Salisbury.
In case all the. members of said Commission shall resign at
the same time, then all of the vacancies thereto shall be filled
by the Mayor of Salisbury, subject to confirmation by the
Council of Salisbury. The Commission shall appoint, dis-
charge at pleasure and fix the compensation of a secretary-
treasurer, a chief engineer and such engineering, legal, clerical
and other force and help as from time to time in its judgment
may be deemed necessary to carry out the provisions of this
Act, and may exact from them, or any of them, such indemnity
bond as it may deem proper. The said Commission shall
publish semi-annually in one or more newspapers published in
the City of Salisbury a full and true account of its receipts,
expenses and expenditures under this Act. Prior to such
publication its accounts shall be audited by a certified public
accountant to be employed and paid by the Commission.
SEC. 3. And be it further enacted, That the Mayor and
Council of Salisbury, in addition to the powers already pos-
sessed by it, shall have the right and power, acting by and
through the agency of the said Commission, to acquire by gift,
purchase, lease or condemnation any land, improvements, rights
of way, source of water supply, and stream bed, water way,
water rights, water shed, or any other property of any kind
whatsoever, either in fee or as an easement, within Wicomico
County, whether used for private purposes or already devoted
to a public or quasi-public use, or any interest therein or any
franchise connected therewith, for the construction, extension
and maintenance of any water supply, water main, sewer or
appurtenance thereof, or for any sewage disposal plant, reser-
voir, water purification plant, tank or pumping station, or for
any other purpose in connection with the water and sewer
systems of the City of Salisbury; and whenever resort shall be
had to condemnation proceedings, the proceedings shall be as
provided by Article 33A of the Annotated Code of Maryland,
regulating: the procedure for the acquisition of property for
public use by condemnation, and all the rights, powers and
privileges conferred by said Article, relating to the condemna-
tion of property for public use, are hereby expressly conferred
upon and vested in the Mayor and Council of Salisbury, acting
by and through the agency of the said Commission. At any
time after ten days following the return and recordation of
