ap.rd to Same and Saith She is in no Sort guilty of the
charge in the Said Indictm.t Sett forth and thereupon
prays liberty to Imparle thereto untill the third tuesday
in June next w.ch is granted And The afd prop.ry by
Tench Francis Clk of the Indictm.ts consents to y.e Same

    Ordered that ^y.e^ afd Kath.n be by the Court Con.td into y.e Custody of John Gresham
Gent high Sherf of Said County untill She Should give Security for her
appearance at next Court to Answ.r unto y.e afd Indictment &c.a and in the mean
time She is to be of good behav.r  And thereupon the Same is Cont.d

 Kent County fs.t The Jurors for the Right Honble the Lord
Prop.ry that now is for the body of Kent County afd upon
their oath do present that Benjamin Kear of Shrewsbury
parish in the County afd planter the day of December
Anno Dom. Seventeen hundred & twenty Eight at the Parish
afd in the County afd within the Jurisdiction of this Court in & upon A
Certain Jane Tannen in the Peace of God and of the Said Lord Propry then
& there being with force & Arms An Assault did make and her the said
Jane then and there did beat wound & Evilly treat so that of her life it
was much Despair and other harms to her then and their did to the
great damage of the Same Jane and Contrary to the Peace of the said
Lord Propry that now is his good Rule and Government &c.a

    And the afd Benjamin in his proper person cometh and Saith that
he is in no sort guilty of the premises upon him imposed as by the afd
Indictment it is alledged and thereupon Submits himself to the Court
                                                        Benjamin Kear in p.r p.a

    Therefore it is Considered by the Court here at the Court House in the
Town of Chester in Said County on the third tuesday in March being the Eighteenth
day of Said Month Anon Dom. Seventeen hundred and twenty Eight That the afd
Benjamin Kear be find the Sume of five hundred pounds of Tobacco to the use of the
Right Hon.ble the Lord proprietarie for his offence afd &c.a  And also that to pay
the Sume of Three hundred and fifty pounds of Tobacco Costs on the premises
afd to the officers of this Court

    Ordered by the Court here That John Gresham Gent high Sherf of Said Court
keep the afd Benjamin Kear in Safe Custody untill the fine and fees afd he
shall Satisfie
