59 John Evans On the back of the preceeding Indictm.t was endorsed viz.t Billa Vera Henry Evans And the afd Thomas Martin in his proper person Comes And Saith that he cannot gainsay the Indictm.t afd So as afd against him brought nor but that he is guilty of the premises upon him Imposed as by the afd Indictm.t it is alledged And Thereupon Submits to the Court Therefore it is Considered by the Court here at the Court House in the Town of Chester in Said County on the third tuesday in March being the Eighteenth day of Said Month Anno Domini One Thousand Seven hundred and twenty Eight That the afd Thomas Martin Stand in the pillory for the Space of half an hour And that afterwards he receive at the publick whipping post twenty one Lashes well laid on his bare back till the blood appears as a punishment for his afd Crime of Committing felony as by the afd Indictm.t is Sett forth Also it is Considered that the Said Thomas Martin pay forty Shillings Current money it being the full Value of the four fold of the Silver Spoon as afd Stoln the Same being valued at Ten Shill and that also the Value of the Said Spoon be also made good to the afd Mary Moll. And also pay the Sume of two hundred and fifteen pounds of Tobacco Cost Accrueing on the premises afd to the officers of this Court Jam.s Smith Clk It is also Considered by the Court here at this day to wit the day and year last mentioned That the Sherf of Kent County take the afd Thomas Martin into his Custody and Execute the punishm.t in the Judgment afd Specified and afterwards to bring him into Court againe Of which receipt the said Sherf to wit John Gresham high Sherf of Kent County makes return on the day and year last said That he hath Executed the said Judgment and also hath here the Said Thomas Martin before the Court The Said M.r William Nicholson being obliged to pay the four fold afd Amounting to forty Shillings Cur.t money and also the Value of the Spoon being ten Shillings which in the whole amounts to fifty Shill.s Cur.t money and two hundred and fifteen pounds of Tobacco Costs afd for the afd Thomas Martin according to Act of Assembly in Such Case lately made and provided &c.a for the space of One year at the Expiration of his term of Service the said Thomas Martin Shall Serve his Said Mast.r M.r William Nicholson or his assignes The afd William Nicholson on the Eight day July Anno Dom 1728 Ent.rd into Recognizance before M.r Geo Skirven one of his Lord Ships Justices of y.e peace for said County in the Sum of Ten pounds Sterl for the Appearance of the afd Thomas Martin at this Court The said Thomas haveing appeared The Said William Nicholson desired his Recogniz.c for afd Thomas Martain be disch.d And nothing appearing why it should not It is ordered that the same be disch.d &c.a This Court here discharges the same &c.a |
