March Court 1728 Joseph Butler at the Same time afd Entered into Recognizance for his appearance at this Court in the Sum twenty pounds Sterl to give Evidence on his Ldshp behalfe against the said R.d Foulston the said Jos in his proper person ap.rs It is ordered by the Court here that the Same Recognizance be disch.d The Same is by this Court here disch.d &c.a Ordered by the Court here that the said Rich.d enter again into recogniz.c for his app.rc to next Court Thereupon the said Rich.d Foulston came and acknowledged himselfe Indebted to his Right Hon.ble the Lord prop.ry in the Sume of Twenty pds Sterl to y.e use of his s.d Lordship his heirs & Successors to be Leveyed on his goods and Chattles Lands and Tenements Conditionally that if the said Rich.d shall not make his personall appearance at the next Court to be held for Kent County on the third tuesday in June next then and there & suffer.d unto a Certain Information of Those beet ag.st him and in the mean time he is to be of good behaviour wherewith he acknowledge himselfe to be Content And y.e Information is Con.td Ordered by the Court here that a Certain Joseph Butler as an Evid.c enter into Recog.c for his Ldshp against y.e s.d Rich.d Thereupon the said Joseph Butler in his proper person acknowledges himselfe Indebted to his Ldship his heirs & Successors in the Sum of twenty pounds Sterl to be leveyed on his goods & Chattles Lands and Tenements Conditionally that if he Shall not ap.r at next Co.t and give his Evid.c as afd against the said Rich.d wherew.th he Acknowledge himselfe Content
day of October Anno Dom Seventeen hundred twenty And Eight with force and Arms at the parish afd in the County afd within the Jurisdiction of this Court one quart botle filld with gunn powder of the value of fifty pounds of Tobacco three yards and one half yard of white Lining of the Value of forty pounds of Tobacco three ells of Ozenbrigs linnen of the value of fifty pounds of Tobacco of the goods and chattles of a certain William Foster then and there being found then and there feloniously did steal take and bear away contrary to the peace of the said Lord proprietarie that now is his good rule and government and against the form of the Acts of Assembly in Such Case made and provided T Francis Cler. pac. Test Thomas Wright Billa Vera Henry Evans foreman On the back of the Same was endorsed viz.t And y.e afd W.m Comes in his proper person cometh &saith that he is in no sort guilty of y.e premises above upon him Imposed as by y.e Ind.m as is alledged and therefore he putteth himself upon y.e Country W.m Bonner in p.a psona And he who follows for the Lord Proprietarie in like manner saith he is guilty T francis p Lord P.ry Thereupon Command was given to the Sherf of Kent County that he Immediately cause to come here twelve &c.a By whom &c.a who neither &c.a to Recognize &c.a Because as well &c.a of which said precept the said Sherf to wit John Gresham Gent now here at this day to wit the Eighteenth day of March Anno Dom One Thousand Seven hundred and twenty eight makes return that he hath here Ready twelve &c.a by |
