August Court 1734 and now here at the third tuesday in August the same court last mentioned came the afd Joan Edwards and appeared and prayed her suretys recognizance for her appearance might be discharged ordered by the court here that the same recognizance be discharged as prayed Charles Smith afd his recognizance taken as afd his recognizance taken for the appearance of the afd Joan Edwards is by this court here discharged there being no cause Shewn in the contrary The Examination upon oath of Joan Edwards saith that she is with Child to Thomas Martin and the deponant saith that he is the begitter and no other taken before me this first day of July 1734 Ebenz Blackiston Thereupon this court orders that Tench Francis Clk of the Indictments of this court exhibits an Information against the afd Thomas Martin and the afd complaint After which came the afd Attorney for his Lordship and exhibits the Information on the same which is as followeth viz.t Kent County fs.t Be it remembred that Tench Francis Gent. attorney of the right honourable the Lord proprietary that now is who for the same Lord proprietary in this part prosecuteth doth come here into the County Court of the same Lord proprietary held for Kent County afd to wit at Chester Town in the County afd the twentieth day of August Anno Domini seventeen hundred and thirty four before James Harris Esq.r and his associates the said Lord proprietary his Justices of the same County Court and for the same Lord proprietary doth give the same Justices here to understand and be informed that Thomas Martin late of S.t pauls parish in the County afd planter the tenth day of June Anno Domini seventeen hundred and thirty three at the parish afd in the Court afd within the Jurisdicion of this court did commit fornication with a certain Joan Edwards and of her body then and there had carnal knowledge and bastard child on the body of her the same Joan then and there did beget to the high displeasure of Almighty God to the evil example of all others in such case offending contrary to the peace of the said Lord proprietary his good rule and Government against the form of the Act of Assembly in such case made and provided &c.a Wherefore the same attorney of the said Lord proprietary for the same Lord proprietary prayeth the advice of the Court here in the premisses and that due process of Law in this part against the afd Thomas may be made to answer unto the said Lord proprietary of and upon the premisses &c.a T francis And the same Thomas in his proper person comes and defends the force and injury entered and saith he is in no sort guilty of the premisses above upon him imposed and the same puts himself on the Country Martin in propriea persona After which came into court the afd Thomas Martin and saith that notwithstanding the averment afd he comes and withdraws his plea afd And now saith that he cannot gainsay the Information as above suggeted but that he is guilty of the fornication as by the afd Information it is alledged and thereupon submits to the court Therefore it is Considered by the Justices here to wit at Kent County at the Court house in the town Chester in said County on the third tuesday in August being the twentieth day of said Month Anno Dom. one thousand seven hundred and thirty four That the same Thomas Martin to receive on his bare back twenty one Lashes well laid on his bare back tell the blood appear as a punishment for commiting the fornication afd in form afd confest and also pay the sum of five hundred and eight pounds of Tobacco cost accrueing on the premisses afd to the officers of this Court It is also Considered by the Court on the day and year last mentioned that the sherf of Kent County take the afd Thomas Martin into his custody and execute the punishment in the Judgment afd specified and should take him into court againe of which precept John Gresham Gent. Sher. of Kent County make return that he had Executed the punishment in the Judgment specified p Jn.o Gresham |
