August Court 1734 force and Arms one Cask of the value of one hundred pounds of Tobacco filled with Cyder of the value of two hundred pounds of Tobacco of the goods & Chattles of George Moore then & there being did breake Stave and destroy so that the Cyder afd was wholly Spilled and Lost to the Great Damage of the Said George and against the peace &c.a And that the same Sherriff have at the time and place afd the same writ &c.a Att which Said third tuesday in August being the twentieth day of Said Month Anno Dom. one thousand Seven hundred and thirty four being the day of return of Said Writt Came John Gresham Gentl. Sherriff of Kent County and made return thereof to the Court here thereof endorsed as foll. viz.t Cepi Corpus p Jn.o Gresham Sheriff Kent County fs.t Memorandum that Tench Francis Gent attorney of the right Honourable the Lord prop.ry that now is for the County afd who for the same Lord prop.ry in this part prosecuteth doth come here into Kent County Court before James Harris Esq.r and his associates his Lordships Justices of the Same County Court to wit at Chester Town in the afd County the third tuesday of August Anno Dom. Seventeen hundred thirty & four and for the same Lord prop.ry doth give the Court here to understand and be informed that Joseph Nicholson late of S.t pauls parish in the County afd Gent the tenth day of March Anno Dom. Seventeen hundred thirty & three at the parish afd in the County afd within the Jurisdicion of this Court with force & arms one Cask of the value of one hundred pounds of Tobacco filled with Cyder of the value of two hundred pounds of Tobacco of the goods and Chattles of George Moore then and there being did break Stave and destroy so that the Cyder afd was totally Spilled and lost to the great Damage of the said George and against the peace of the Said Lord prop.ry his good Rule & Government wherefore the afd attorney prayeth the advice of the Court here in the premisses for the said Lord proprietary and due process of Law against the afd Joseph in this part to Issue to answer to the said Lord proprietary of and upon the premisses &c.a T francis Clk par.
