1733 &c.a T francis Test John Wright jun.r Margret Shippey On the Preceeding Indictment was endorsed as foll. viz.t True bill by Rob.t Dunn foreman And now at this Court to wit at Kent County at the Court house in the Town of Chester in Said County on the third tuesday in March being the nineteenth day of Said Month Anno Dom. One Thousand Seven hundred and thirty three Came the afd The Lord prop.ry by Tench Francis his attorney and the Same Mary Spearman in her proper person and his Said Lordship by his Said Attry prays that the Same Mary may answer as afd And the afd Mary Spearman in her proper person and present in Court Saith that She is not ^in any Sort and thereupon She put herself upon the Country Mary Spearman in prop.r p.rson And he who follows for the Lord Proprietary in like manner Saith She is guilty T francis p L.d p.ry Thereupon Command was given to the Sherrif of Kent County that he Immediately cause to Come here twelve &c.a by whom &c.a who neither &c.a To Recognize &c.a Because as well &c.a of which said precept the Said Sherrif to wit John Gresham Gentl. now here at this day to wit the nineteenth day of March Anno Dom. One Thousand Seven hundred and thirty three makes Return that he hath here ready twelve &c.a as by his precept he was Commanded and now here afterwards to wit the day and year last mentioned came againe the afd Lord prop.ry by his attorney afd and the Same Mary Spearman in her proper person and the Jurors of that Jury being Impannelled and Called Likewise Came to wit Thomas Smith Richard Gresham Morgan Hurtt John Carvill Balman Medford Alex.r Bresno William Woodland John Rogers Harry Spencer John Cooper Thomas Wiatt Charles Smith who being duely Elected tryed and Sworn to Say the truth in the premisses (And the Same Mary in her proper person appeared) and the Same Jurors upon their Oath do Say Mary Spearman is guilty of the felony afd as she Stands Indicted and by Thomas Smith there foreman all So Say Therefore it is Considered by the Justices here to wit at Kent County at the Court House in the Town of Chester in Said County on the third tuesday in March being the nineteenth day of Said Month Anno Dom. One Thousand Seven hundred and thirty three That the afd Mary Spearman Stand half an hour in the pillory and Receive on her bare back fifteen lashes well laid on tell the blood appear ^a punishment for Committing the felony afd^ And also pay the four fold of the afd goods being valued at fifty pounds of Tobacco the four fold of which amounts to the Sum of two hundred pounds of Tobacco to be paid to the Same Margaret Shippey And also pay the Sum of Seven hundred and Eighty two pounds of Tobacco Cost Accruing on the Premisses afd to the officers of this Court It is also Considered by the Court here at this day to wit the day and Year last mentioned that the Sherrif of Kent County take the afd Mary Spearman into his Custody and Execute the Punishment in the Judgment afd Specified and afterwards to bring her into Court againe of which precept to wit John Gresham Gentl. Sherrif of Kent County makes Return on the day and Year last Said that he hath Executed the Punishment in the Judgment afd Specified and also hath here |
