487 Sum of ten pounds Sterl. who made and Leveyed on his body goods and Chattles Lands and Tenements to the use of his Said Lordship his heirs and Successors Conditionally that if he does not any time dureing this Court prosecute the afd William Collins for assaulting him and in the Same time Theophilus acknowledges himself to be Content This Court orders that James Cann an Evidence enter into Recognizance for his appear.c any time dureing the Courts Sitting Thereupon the Same ^James^ Cann of Kent County Planter present in Court in his proper person and Acknowledged himself Indebted to the Right hon.rble the Lord prop.ry in the Sum of five pounds Sterling to be made and Leveyed on his body goods and Chattles Lands and Tenements to the use of his Lordship his heirs and Successors Conditionally That if He the Same James Cann Shall not any time dureing this Court appear as an Evid.c for his Said Lordship against the Said William Collins wherewith he Acknowledges himself Content This Court orders that James Lynch enter into Recognizance with Security as an Evidence against the Said William Collins Thereupon the Same James Lynch of Queen Anne County Planter present in Kent County Court and Acknowledged himself indebted to the right Hon.rble the Lord prop.ry in the Sum of five pounds Sterl. to be Leveyed on his goods and Chattles body Lands and Tenements to the use of his Said Lordship his heirs and Successors Conditionally that if he doth not any time during this Court give his Evidence on his Lordships behalf against the afd William Collins for his assaulting the afd Theophilus Randall wherewith he Acknowledges himself to be therewith Content Also Theophilus Randall of Kent County Planter present in Court in his proper person and Acknowledged himself indebted to the Right hon.rble the Lord prop.ry in the Sum of five pounds Sterling to be made ^&^ Leveyed on his body goods and Chattles Lands and Tenements to the use of his Said Lordship his heirs and Successors That if the afd James Lynch Shall not at any time dureing this Courts Sitting appear and give his Evidence on his Lordship behalf against the Said ^William ________________^ Theophilus Randall wherewith the Same Theophilus Acknowledges himself Content And Theophilus Randall James Cann and James Lynch Sworn as Evid.c to the Grand Jury after which The Grand Jury returns the following Indictm.t viz.t Kent County fs.t The Jurors for the Right honourable the Lord proprietary that now is for the Body of Kent County afd upon their Oath do present that William Collins late of Shrewsbury Parish in the County afd Labourer the Nineteenth day of March in the year of our Lord God Seventeen hundred and thirty three at the Parish afd in the County afd within the Jurisdiction of this Court in and upon a Certain Theophilus Randall of the Same County Planter in the peace of God and of the Same Lord prop.ry then and there being with force and Arms an assault did make and the Same Theophilus then and there did beat wound and evilly treat so that of his life it was greatly despaired and other harms to him then and there did to the great Damage of the Same Theophilus and against the peace of the Same Lord proprietary that now is his good Rule and Government |
