481 afd upon their oath do present that Mary Graves late of S.t Pauls Parish in the County afd Spinster then and there a free Mullatto and the Servant of Arthur Miller of the Same Parish and County Gentl. being the tenth day of May Anno Dom. Seventeen hundred thirty & three at the Parish afd in the County afd within the Jurisdicion of the Court did Committ fornication with a person to the Jurors afd unknown and did permit the Same unknown person then and there to have carnal knowledge of her body and to beget then and there a bastard child on the body of her the Same Mary which Same bastard child the Said Mary afterward to wit the tenth day of ffebruary Anno Dom. Seventeen hundred thirty and three at the Parish afd in the County and Jurisdicion afd did bear contrary to the peace of the Said Lord prop.ry his good rule and Government and against the form of the Act of Assembly in Such case lately made & provided Test Arthur Miller & Sarah his wife T francis On the Same Indictment was endorsed as foll. viz.t True bill by me Rob.t Dunn foreman And now here at this Court to wit at Kent County at the Court House in the Town of Chester in Said County on the third tuesday in March being the nineteenth day of Said Month Anno Domini One Thousand Seven hundred and thirty three Came The Lord prop.ry by Tench Francis his att.ry and the Same attorney prayed that the afd Mary Graves might to the Indictment afd Answer So as afd against her brought And the afd Mary Graves came and in her proper person appeared and Saith that She Cannot gainsay the Indictment afd So as afd against her brought nor but that She is guilty of the premisses above upon her Imposed as by the afd Indictment it is alledged And thereupon Submits to the Court Therefore it is Considered by the Justices here to wit the Same day and year last mentioned That the afd Mary Graves at the Expiration of her Service She is to Compleat (as also for the time in the Judgment afd on the other Indictment) She Serve Seven Years to the use of the afd County for her Committing the offence afd in form afd Confest according to Act of Assembly in such case lately made and provided And also pay the sum of Two hundred Seventy and Nine pounds of Tob.o fees accrueing to the officers of this Court on the premisses afd Ordered by this Court that the afd Mary Graves for the Loss here in bareing the afd Child disgrace of her Masters House Charge in bringing to bed She Serve at the Expiration of her time of Service One whole Year to the Same Arthur Miller for his heirs or assigns This Court Orders that a Note be Set up at the Court House Door that there shall be disposed of two Mullatto Children one ^ab.t^ two Year old the other ab.t Six weeks Copy of which order was Accordingly done Ordered by the Court that M.r Arthur Miller have allowance of one thousand pounds of Tobacco for keeping the afd two Mullatto Children to this Court at the Laying _________ at next November M.r Arthur Miller comes into Court and desires the afd Mullatto was also _________ two Seven Years afd And also the afd Mullatto Children to whim the Contrary _______ _______ paying five hundred pounds Tob.o to the afd Sherrif of Kent County _______ __________________________________________________________________ __________________________________________________________________ |
