1733 fornication with Rachel Dowlin and then and there did begett a bastard Child on the body of the SAme Rachel to the high Displeasure of Almighty God to the Evil Example of all others in Such case offending Contrary to the peace of the Said Lord proprietary his Good Rule and Government and against the fform of the Act of Assembly in Such Case made and provided T francis Cler. pac. Test Rachel Dowlin And now here at this Court to wit at Kent County at the Court House in the Town of Chester in Said County on the third tuesday in November being the twentieth day of Said Month Anno Dom. One Thousand Seven hundred thirty three Came the afd Ld prop.ry for his attorney afd And prayed that the afd John Howell might to the Indictment afd Answer and the Same John Howell in his proper person cometh and Saith that he Cannot gainsay the Indictment afd So as afd against him brought nor but that he did the fornication afd as by the afd Indictment it is alledged And Thereupon Submits to the Court Therefore it is Considered by the Justices here to wit at Kent County afd the Same day and year last mentioned That the afd John Howell be find the Sum of thirty Shillings Current money of the province afd to the use of the afd County according to Act of Assembly in Such case lately made and provided &c.a Also it is Considered by the Same Justices That the afd John Howell pay the Sum of two hundred Eighty Six pounds of Tobacco Costs accrueing on the premisses afd to the officers of this Court &c.a Ordered by this Court here that fine afd be Delivered the Sherrif accordingly afterwards to wit the Same day last mentioned came John Gresham Gentl Sherriff of Said County and acknowledged that he had Paid the ffine afd
to the use of his Said Lordship his heirs and Successors Conditionally That if the afd Pharo Mingo Shall not make his personall appearance at the next Court to be held for Said County On the third tuesday in November then next ensuing at the County Court House to Answer unto what Shall be objected against him for feloniously Stealing one Pen knife and pare of buttons the goods and Chattles of a Certain John Gelleylean and in the mean time he is to be of good behaviour wherewith he Acknowledges himself Content Likewise at the Same time Came Daniel Ferrill and Thomas Mahawn both of Kent County Planters and present in their proper persons before me And Acknowledged themselves Indebted to the Right Hon.rble the Lord prop.ry of the Province afd in The Sum of five pounds Sterling Each to be made and Leveyed on their bodys goods and Chattles Lands and Tenements to the use of his SAid Lordship his heirs and Successors afd at the next Court to be held for Said County at the Court House on the third tuesday in November then next ensuing to answer unto a Certain Fellony for Stealing one pen knife and on pare of buttons the goods and Chattles of a Certain John Gelleylean and in the mean time he is to be of Good behaviour wherewith they Acknowledge themselves Each of them to be Content &c.a In Testimony whereof I have Sett my hand and Seall this Eleventh day of Octo.r 1733 Henry Evans Also at the Same time afd came John Gelleylean before men and in his proper person acknowledged himself Indebted to the Right Hon.rble the Lord proprietarie of the province in the Sum of ten pounds Sterling to be made |
