November Court 1733 Lord proprietary his good rule and Government Wherefore the afd Attorney prayeth the assize of the Court here in the premisses for the Said Lord prop.ry and due process of Law against the afd James Robass in this part to Issue to answer to the Said Lord prop.ry of and upon the premisses &c.a T francis Cler. pac. And The afd James Robass in his proper person cometh and Saith that he is in no Sort guilty of the premisses above upon him imposed as by the afd Information it is alledged and thereof he putteth himself upon the Country James Robass in p.r p.a And he who followeth for the Lord proprietarie in like manner Saith he is guilty T francis p Ld p.ry Thereupon Command was given to the Sherriff of Kent County that he Immediately cause to come here Twelve &c.a by whom &c.a who neither &c.a to Recognize &c.a because as well &c.a of which Said precept the Said Sherriff to wit John Gresham Gentl. now here at this day to wit the twentieth day of November Anno Dom. One Thousand Seven hundred and thirty three makes return that he hath here ready twelve &c.a As by his precept he was Commanded And now here afterwards to wit the day and year last mentioned came againe the afd Lord prop.ry by his attorney afd and the afd James Robass in his proper p.rson and the Jurors of that Jury being Impannelled and Called likewise Came to wit Arthur Miller Joseph Nicholson Jonas Ringgold Richard Knoulman Nicholas Massey Samuel Wallis and John Earle who being duely elected tryd and Sworn to The att.ry of the afd Lord prop.ry Informs the Court that the Information afd is by mistake Wrong Therfore desires that a Juror may be withdrawn and that the Same Jury may be discharged from giveing and Verdict in the afd Cause upon which the Court orders that John Earle being one of the afd Jury be withdrawn which was Immediately done And Thereupon the Same Jury was discharged &c.a This Court orders that the Clk of the Indictments of this Court Exhibit an new Information against the afd James Robass which was Accordingly done and is as followeth viz.t Kent County fs.t Memorandum that Tench Francis Gent. attorney of the Right honourable the Lord prop.ry that now is for the County afd who for the Same Lord prop.ry in this Court prosecuteth doth come here into Kent County Court before James Harris Esq.r and his associates his Lordships Justices of the Same County to wit at Chester Town in the afd County the twenty first day of November Anno Dom. Seventeen hundred thirty and three and for the Same Lord prop.ry doth give the Court here to understand and be informed that James Robass late of S.t Pauls Parish in the County afd Joyner the tenth day of January Anno Dom. Seventeen hundred thirty and two at the parish afd in the County afd within the Jurisdicion of this Court falsly fraudulenty deceitfully and unjustly to James Cradock of the Same County mariner did affirm and assert that he the Same James Robass then and there was called and known by the name of Richard Mason and that the Said James Robass by and in the name of the Said Richard Mason then and there falsly fraudulently deceitfully and unjustly divers goods Wares and Merchandizes of the goods and Chattles of George Strange Jun.r of the value of two hundred pounds of Tobacco for Tobacco to be paid thereafter did buy and promise afd and that the Said James Robass falsly fraudulently deceitfully and unjustly then and there is and by the name of the Said Richard Mason to the Same James Cradock did promise that he the Said James Robass by the name of Richard Mason afd Tobacco for the Same goods Wares and Merchandizes unto John Harvy on behalf of and to his use the virtue of of the Said George Strange jun.r taken thereto afterwards he Should be required well and faithfully would pay and Content Whereas in truth and in fact the said James Robass never was called known or reputed by the name of Richard Mason to the great damage and deceit of the said George Strange to the Evil Example of |
