Said County on the third tuesday in November being the twentieth day of Said Month Anno Dom. One Thousand Seven hundred and thirty Three Came the afd James and in his proper person appeared and prayed his Recognizance and his Suretys Recognizance for her appearance be discharged Ordered by this Court that the Same Recognizance and his Suretys Recognizance for his appearance be discharged James Robass afd his Recognizance taken in the Sum of twenty pounds Sterl. for his appearance to this Court to answer as afd the Same Recognizance is by this Court here disch.d there being no cause Shewn to y.e County Thomas Morsell his Surety in the Sum of twenty pounds Sterling for the Appearance at this Court if the afd James Robass as afd The Same Recognizance is by this Court here disch.d there being no Cause Shewn to the Contrary Ord.rd that the Same James Robass be Comm.d Kent County fs.t Memorandum that Tench Francis Gentl. attorney of the right Honourable the Lord prop.ry that now is for the County afd who for the Same Lord prop.ry in this part prosecuteth doth come here into Kent County Court before William Frisby Esq.r and his associates his Lordships Justices of the Same County to wit at Chester Town in the afd County the Twenty first day of August Anno Dom. Seventeen hundred thirty & three and for the Same Lord prop.ry doth give the Court hereto understand and be informed that James Robass late of S.t Pauls Parish in the County afd Joyner the tenth day of January Anno Dom. Seventeen hundred thirty and two at the parish afd in the County afd within the Jurisdicion of this Court falsly fraudulently deceitfully and unjustly to James Stuart of the Same County Mariner did affirm and assert that he the Same James Robass then and there was called and known by the name of Richard Mason and that the Said James Robass by and in the name of the Said Richard Mason then and there falsly fraudulently deceitfully and unjustly divers goods wares and Merchandizes of the goods wares and Merchandizes of the goods and Chattles of George Strange Jun.r of the Value of two hundred pounds of Tobacco for tobacco to be paid thereafter did buy and purchase and that the Same James Robass falsly fraudulently deceitfully and unjustly then and there and by the name of the Said Richard Mason to the Same James Stuart did promise that he the Said James Robass by the name of Richard Mason afd, Tobacco for the Said goods wares and Merchandizes unto John Harvy on behalf of and to the use and behoof of the Said George Strange Junior when thereto afterwards he Should be required well and faithfully would pay and Content Whereas in truth and in fact the Said James Robass never was called known or reputed by the name of Richard Mason to the great Damage and deceit of the Said George Strange to the evil example of all others and against the peace of the said |
