427 Jurisdiction of this Court one _________ of the Value of one hundred pounds of tobacco one Suit of window Curtains & valence for the same of the Value of sixty pounds of tobacco one Callico Chimney cloth of the Value of fourth pds of tobacco one Suit of Bed Curtains of the Value of three hundred pounds of tobacco and one head Cloth for the same Curtains of the Value of sixty pounds of tobacco one earthen punch bowl of the Value of ten pounds of tobacco and Six quart bottles filed with wine Each bottle and the wine therein of the Value of twenty pounds of tobacco being of the Goods and Chattles of the said Elishaw then and there were found then and there feloniousely did Steal take and bear away and that Jane Toas well knowing that the said Timothy the felony afd in form afd had Commit'd and perpetrated the said Good & Chattles from the said Timothy after the Commission of the same felony to wit the same Day and Year at the said parish and County feloniously did receive and take Contrary to the Peace of the said Lord prop.ry his Good rule and Government and ag.t the form of the form of the Act of Assembly in such Case made And the afd Timothy Roberts in his proper person cometh and Saith that he is in no sort Guilty of the premisses above upon him imposed as by the afd Indictm.t it is alledged and thereof he putteth himself upon the Country Timothy Roberts in prop.r ps.a And he who followeth for the Lord proprietarie in like manner Saith he is guilty T francis p Ld p.ry Thereupon Command was given to the Sherrif of Kent County that he Immediately Cause to come here twelve &c.a by whom &c.a who neither &c.a To Recognize &c.a Because as well &c.a of which said precept the Said Sherrif to wit John Gresham Gentl now here at this day to wit on the third tuesday in August Anno Dom. One Thousand Seven hundred and thirty three makes return that he hath here ready twelve &c.a as by his precept he was Commanded And now here afterwards to wit the day and year last mentioned come againe the afd Lord prop.ry by his att.ry afd and the Said Timothy Roberts in his proper person and that Jurors of that Jury being Impanneled and Called Likewise Came to wit John Tilden Stephen Glanvill Thomas Piner George Medford Richard Knoulman George Vansant Joshua Vansant Thomas Wiat John Brown Robert Lisby William Hynson & Samuel Beck who being duely elected tryd and Sworn to Say the truth in the premisses upon their Oath do Say that Timothy Roberts is guilty of the ffelony above by the Indictment alledged as he Stands Indicted and by John Tilden there foreman all So Say |
