1733 The Same Timothy Roberts haveing heard the Verdict of the Jurors afd against him And being asked if he had anything to offer why Judgment Should not be gave against him on the Verdict of the Jurors afd to which he Said he had nothing to offer to the Contrary Therefore it is Considered by the Justices here to wit at Kent County at the Court House in the Town of Chester in Said County on the third tuesday in August being the twenty first day of Said Month Anno Dom. One Thousand Seven hundred and thirty three That the afd Timothy Robert pay the four fold of the Goods afd Stoln (being valued at five hundred twenty Six pounds of Tobacco) the four fold Amounting to the Sum of two Thousand one hundred and four pounds of Tobacco to the afd Elishaw Stringfellow the proper person the goods afd did belong And also Stand in the Pillory half an hour and to have on his bare back twenty five Lashes well laid on his bare back till the blood appear &c.a as a punishment for Commiting the felony afd According to the force form and effect of the Verdict afd and also it is Considered that the Said Timothy Roberts pay when he is free to his afd Master the Sum of Seven hundred and twenty five pounds of Tobacco cost Accrueing on the premisses afd to the officers of this Court According to Act of Assembly in Such case lately made and provided &c.a It is also Considered by the Court here at this day to wit the day and year last mentioned That John Gresham Gentl Sherrif of Kent County take the afd Timothy Roberts into his Custody and Execute ^the^ punishment in the Judgment afd Specified and afterwards to bring him into Court againe Of which precept to wit John Gresham Gentl Sherrif of Kent County makes return on the day & year last Said that he hath Executed the punishment in the Judgment afd and also hath here the said Timothy Roberts before the Court &c.a And the afd Jane Toas of the Same Parish and County the wife of Richard Toas in her proper person cometh and Saith that She is in no Sort guilty of the premisses above upon her imposed as by the afd Indictment it is alledged and thereof She puteth herself upon the Country Jane Toas in proper pson And he who followeth for the Lord prop.ry in like manner Saith She is guilty T francis p Ld p.ry |
