August Court 1733 Said lord proprietary then and there being an assault did make and her the s.d Martha then and there did beat wound and evilly treat So that of her life it was much despaired and other harms to her then and there did to the great Damage of the Said Martha and against the peace of the Said Lord prop.ry his good rule and Government &c.a T francis Cler. pac. Test Martha Tidmarsh The Same Indictment was endorsed viz A true bill p Simon Wilmer foreman And The afd Henry Barber came and in his proper person Saith that he Cannot gainsay the Indictment afd So as afd against him brought nor Can he Say but that he he is guilty of the assault afd as by the afd Indictment it is alledged and thereupon Submits to the Court Therefore it is Considered by the Justices here to wit at Kent County Court House in the Town of Chester in Said County on the third tuesday in August being the twenty first day of Said Month Anno Dom. One thousand Seven hundred thirty three That the afd Henry Barber pay the Sum of one thousand pounds of tobacco to the use of his Lordship as a fine for Commiting the assault afd in forme afd Confest and also pay the Sum of two hundred Eighty three pounds of Tobacco costs Accrueing on the premisses afd to the officers of this Court Jam.s Smith Clk Ordered by this Court that Henry Barber of Kent County Labourer Enter into recognizance with Security for his appearance to next Court Thereupon the Same Henry Barber of Kent County Labourer in his proper person present in Court came and Acknowledged himself Indebted to the Right honourable the Lord proprietarie in the Sum of tenn pounds Sterling to be made and leveyed on his body goods and Chattles Lands and Tenements to the use of his said Lordship his heirs and Successors Conditionally that if he doth not make his appearance at next Court to be held for said county on the third tuesday in Nov.r next and in the mean time he is to be of good behav.r wherewith he acknowledges himself to be Content Likewise Came Abraham Ambrose of Kent County planter and Nehemiah Powell of Kent County Inholder and in the proper person in Court came and Acknowledged themselves Indebted to the right honourable the Lord proprietarie in the Sum of five pounds Sterl each to be made and Leveyed on their bodies goods and Chattles Lands and Tenements to the use of his Said Lordship his heirs and Successors Conditionally That if the afd Henry Barber Shall not appear at the next Court to be held for Said County on the third tuesday in November next and in the mean time he is to be of good behav.r |
