387 bailiwick and him Safe keep So that he have his body before the Justices four Said County Court Immediately now held at the Court House in the town of Chester in Said County to Answer unto an Information for Commiting fornication with a Certain Elizabeth Clark And that the same Sherrif have at the Said Court the Same Writt &c.a Att which Said Court to wit at Kent County at the Court house in the Town of Chester in Said County on the third tuesday in June being the nineteenth day of Said Month Anno Dom. One Thousand Seven hundred and thirty and three being the day of return of Said writ Came john Gresham Gentl Sherrif of Said County and made return to the Court here thereof endorsed as foll. viz.t Cepi Corpus p Jn.o Gresham Sherf Kent County fs Be it Remembred that Tench Francis Gent attorney of the right Honourable the Lord Proprietary that now is who for the Same Lord Proprietary in this part prosecuteth doth come here into the County Court of the Said Lord Proprietary held for Kent County afd to wit at Chester Town in the County afd the twenty third day of June in the Year of our Lord God Seventeen hundred thirty & three before William Frisby Esq.r and his Associates the Lord Proprietary his Justices of the Same County Court and for the Same Lord Prop.ry doth give the Same Justices here to understand and be informed that Patrick Fitzgrald late of S.t Pauls Parish in the County afd Planter the tenth day of June in the Year of our Lord God Seventeen hundred and twenty eight at the parish afd in the County afd within the Jurisdicion of this Court did Commit Fornication with a certain Elizabeth Clark and of her body then and there had carnal knowledge and a bastard child on the body of of her the Same Elizabeth then and there did beget to the high displeasure of Almighty God to the evil Example of all others in Such case offending Contrary to the peace of the Said Lord Proprietary that now is his good rule and Government and against the form of the Act of Assembly in Such case lately made and provided &c.a Whereupon the Same Attorney of the sd Lord Proprietary for the Same Lord Proprietary prayeth the advice of the Court her in the premisses and that due process of Law in this part against the afd Patrick may be made to Answer unto the Same Lord Proprietary of and upon the premisses &c.a T francis And the afd Patrick Fitzgrald comes and Saith that he Cannot gainsay the Information afd So as afd against him brought nor can he Say but that he is guilty of the premisses above upon him imposed as by the afd Information it is alledged And thereupon |
