November Court 1732 Seventeen hundred and and thirty two at the parish afd in the County afd within the Jurisdicion of this Court in and upon John Gambell in the peace of God and of the Said Lord prop.ry then and there being with force and Arms an assault did make and him the Said John Gambell then and there did beat wound and evilly treat So that of his life it was much despared and other harms to him then and there did to the great damage of the said John Gambell and against the peace of the Said Lord proprietary his good rule and dignity &c.a The Same Indictment was endorsed A true bill p James Moore foreman And the afd James Hogans in his proper person cometh and Saith that he Cannot gainsay the Indictment afd So as afd against him brought nor can he say but that he is guilty of the assault above upon him imposed as by the afd indictment it is alledged and thereupon Submits to the Court Therefore it is Considered by the Justices here to wit at Kent County Court House in the Town of Chester in Said County on the third tuesday in November being the twenty first day of Said Month Anno Domini Seventeen hundred and thirty two That the afd James Hogans pay the Sum of One hundred pounds of Tobacco As a fine for Commiting the assault afd in form afd Confest also it is Considered that the afd James Hogans pay the Sum of two hundred and twenty Eight pounds of Tobacco costs accruing on the premisses afd to the officers of this Court Memorandum that on the day of October Anno Dom. 1732 personally appeared before me John Evans one of his Lord Ships Justices of the peace for Kent County James Hogans of the Said County Planter and did Acknowledge himself to owe and Stand Justly indebted unto the Right Honourable the Lord proprietor of this Province in the Sum of ten pounds Sterling money of his goods and Chattles Lands and Tenements to be made and leveyed to the use of the Said Lord proprietarie his heirs and Successors in case the above bound James Hogans Shall not make his personall appearance at the next County Court to be held for Kent County the third tuesday in November next and to Answer unto Such Matters and things as Shall be then and there objected against him by John Gambell Concerning an assault lately made upon the Said John Gamble by the above bound James Hogans and if he do not depart without Leave by the Court then this recognizance to be void otherwise to be and remain in Force and vertue John Evans And now here at this Court to wit on the third tuesday in November being the twenty first day of Said Month Anno Dom. Seventeen hundred and thirty two and appeared to the afd Recognizance and prayd the Same might be discharged Ordered by the Court here that the Same Recognizance be discharged as prayd The afd James Hogans Recognizance is by this Court here discharged there being no cause Shewn to the Contrary &c.a Kent County fs Be it Remembred that on the tenth day of October Anno Dom. One thousand Seven hundred and thirty two Samuel Norris of the Said County planter personally appeared before me one of his Lordships the Lord p.rtarys Justices |
