331 gainsay the Indictment afd So as afd against him brought nor but can he say but that he is guilty of the Adultery afd as by the afd Indictment is alledged and thereupon Submits to the Court Therefore it is Considered by the Justices here to wit the Same day and year last mentioned That the afd James Boyer pay the Sum of three pounds Current money as a fine for Commiting the offence afd in form afd Confest And also it is Considered That the afd James Boyer pay the Sum of five hundred & forty Eight pounds of Tobacco costs accruing on the premisses afd to the officers of this Court This Court orders that John Gresham Gent Sherriff of Said County keep the afd James Boyer in Custody untill he Shall Satisfie the fees in both Indictm.ts to the officers of this Court John Brown Junior an Evidence against Same comes into Court and being Same Saith that he attended the Same cause three days Ordered by this Court that the afd James Boyer pay the Sum of Ninety pounds of Tobacco for his attend.c as afd to the afd John Brown Rachel Bostick an Evidence against same comes into Court and being Sworn Saith that She attended the Same cause three days Ordered by this Court that the afd James Boyer pay to the Same Rachel Bostick the Sum of Ninety pounds of Tobacco for her attendance as afd Kent County in Maryland Be it Remembred that on the tenth of this Instant October 1732 Robert Macay and Charles Smith did Acknowledge themselves Justly Indebted unto the Right honourable the Lord proprietary of the province of afd in the Sum of Twenty pounds Sterling money Each to be Leveyed on there Bodies goods and Chattles Lands and Tenements Conditionally that if a Certain James Boyer of the afd County Do not make his personall appearance before the Justices of Kent County Court on the third tuesday of November next then and there to answer unto all Such matter and things as Shall be Objected against him Concerning his begitting a bastard Child on the Body of a Certain Rachel Bostick of the afd County and Do not depart without leave of the Court then the this Recognizance taken before me to be void otherwise to Stand and Remain in full force G Wilson And now here at this Court to wit on the third Tuesday in November being the twenty first day of Said Month Anno Domini Seventeen hundred and thirty two Came the afd James Boyer and in his proper person appeared And prayed his Securitys recognizance taken as afd for his appearance might be discharged Ordered by the Court here that the Same Recognizances as afd be discharged as prayed Robert Macay and Charles Smiths Recognizances as afd are by this Court here Discharged there being no cause Shewn to the Contrary Kent |
