303 proper person appeared to the afd Recognizance and prayd the Same might be discharged Ordered by the Court here that the Same Recognizance be disch.d The afd Recognizance is by this Court here disch.d there being no cause Shewn to the Contrary Be it Remembred that on the twenty fifth day of March 1732 William Tidmarsh appeared personally before me one of the R. Hon.ble the Lord prop.rys Justices of the peace for the County of Kent and Acknowledged himself to be justly indebted unto the Lord prop.ry of this province in the Sum of twenty pounds Sterling to be Levied on his body goods & Chattles Lands & Tenements Conditionally if he Shall make his personall appearance before the Justices at June Court next to be held for the County of Kent to answer unto Such things as Shall be objected against him on his Lordships behalf concerning an assault and Battery by him Committed on a Certain Daniel Perkins & in the mean time if he Shall keep the peace & be of good behaviour then the afd Recognizance to be void & of none effect John Evans And now here at this Court to wit on the third tuesday in June being the twentieth day of Said Month Anno Dom. Seventeen hundred and thirty two Came the afd William Tidmarsh and in his proper person appeared and prayed he might be disch.d from the afd Recognizance Ordered by the Court here that the he be disch.d as prayd This Court here discharges the Same there being no cause Shewn to the Contrary Ordered by the Court here That the Clk of the Indictments of this Court Exhibit an Information against the Same William Tidmarsh on the afd assault which is as followeth viz.t Kent County fs Memorandum that Tench Francis Gent attorney of the right honourable the Lord prop.ry that now is for the County afd who for the Same Lord prop.ry in this part prosecuteth doth come here into Kent County Court before William Frisby Esq.r and his associates his Lordships Justices of the Same County to wit at Chester Town in the County afd the twenty first day of June Anno Dom. Seventeen hundred thirty and two and for the Same Lord prop.ry doth give the Court here to understand and be informed that William Tidmarsh late of S.t Pauls Parish in the County afd Inholder the twenty fifth day of March Anno Dom. Seventeen hundred thirty & two at the parish afd in the County afd within the Jurisdicion of this Court in and upon Daniel Perkins in the peace of God and of the Said Lord prop.ry then and there being with force and Arms an assault did make and the Said Daniel then and there did beat wound & evilly treat So that of his life it was much dispaired and other harms to him then and there did to the Great Damage of the Said Daniel and against the peace of the Said Lord prop.ry his good rule and Government Wherefore the afd Attorney prayeth the Advice of the Court here in the premisses for the Said Lord prop.ry and due process of Law against the afd William in this part to Issue to answer to the Said Lord prop.ry of and upon the premisses &c.a and |
