March Court 1731 then and there being found then and there feloniously did Steal take and bear away contrary to the peace of the Said Lord prop.ry his Good rule and Governm.t and against the form of the Act of Assembly in Such case lately made and provided Test Philip Kennard On the back of the afd bill was enorsed viz.t A true Bill p Edw.d Worrell Foreman And the afd Mary Graham in her proper person cometh and Saith that She is in no Sort guilty of the premises above upon her imposed as by the afd Indictment it is alledged and thereof he putteth herself upon the Country Mary Graham in prop.r person And he who followeth for the Lord prop.ry in like manner Saith She is guilty T francis p Ld p.ry Thereupon Command was given to the Sherf of Kent County that he immediately cause to come here twelve &c.a By whom &c.a who neither &c.a To Recognize &c.a because as well &c.a Of which Said precept the Said Sherrif to wit Joseph Young now here at this day to wit on the third tuesday in March being the twenty first day of Said Month Anno Dom. Seventeen hundred and thirty one makes return that he hath here ready twelve &c.a as by his precept he was Commanded and now here afterwards to wit the day and Year last mentioned came againe the afd the hon.rble the Lord pro.ry by his att.ry and the Said Mary Graham in her prop.r person and the Jurors of that Jury being impannelled and called likewise came to wit Simon Wilmer Samuel Tovey Morgan Hurt John Cooper Charles Griffith John Derrick William Sincocks Isaac Freeman Griffith Jones Thomas Chandler John Dening & John Earle who being duely Elected tryd and Sworn to Say the truth in the premisses upon their Oath Do Say Mary Graham is guilty of the felony above mentioned as She Stands Indicted and by Simon Wilmer there foreman all So Say Therefore it is Considered by the Justices here to wit the Same day last mentioned That the afd Mary Graham for the afd felony found by the Jury afd She Stand half an hour in the pillory and Receive on her bare back at the publick whipping post thirty one lashes well laid on tell the blood appear and also pay the Sum of Fifteen hundred and Sixty pounds of Tobacco the four fold of the goods afd And also it is Considered that She pay the Sum of Six hundred Seventy Six pounds of Tobacco costs Accrueing on the premisses afd to the officers of this Court And that M.r James Stout to whom the afd Mary is a Servant pay the afd Charges as the Act of Assembly in Such case lately made and provided directs It is also Considered by this Court here to wit the Same day last mentioned That the Sherrif of Kent County Court take the afd Mary Graham into his Custody and Execute the punishment in the Judgment afd |
