259 upon the Country And he who followeth for the Lord prop.ry in like manner Saith he is guilty T francis Ld p.ry Thereupon Command was given to the Sherrif of Kent County that he immediately cause to come here twelve &c.a by whom &c.a who neither &c.a to recognize &c.a because as well &c.a of which Said precept the Said Sherf to wit Joseph Young Gentleman now here at this day to wit on the third tuesday in November being the Sixteenth day of Said Month Anno Dom. Seventeen hundred and thirty one makes Return that he hath here ready twelve &c.a as by his pcept he was Commanded And now here afterwards to wit the day and year last mentioned came again the afd Lord prop.ry by his attry afd as the afd John Inch in his proper person by their attrys afd and the Jurors of that Jury being impannelled and called likewise came to wit Robert Dunn John Tilden William Granger William Deane Samuel Thomas John Trew John Hankins John Macay Richard Dowdall Samuel Wallis Thomas Chandler & Daniel Ferrill who being duely elected tryd and Sworn to Say the truth in the premisses upon their Oath do Say John Inch is not guilty of altering the mark of the hog afd and by Robert Dunn there by the Justices here to wit at a Court held for Kent County at the Court House in the Town of Chester in Said County on the third tuesday in November being the Sixteenth day of Said Month Anno Dom. Seventeen hundred and thirty one That the afd John Inch as to the afd Indictment he go thereof without day and that he be therefrom acquit Also it is Considered that the Same John Inch pay the Sum of Nine hundred and Ninety one pounds of Tobacco costs accruing on the premisses afd to the officers of this Court &c.a Jam.s Smith Clk The afd John Inch enterd into recognizance in the Sum of forty pounds Sterl Philip Kennard and James Calder his Suretys 20£ Sterl Each at last August Court being the third tuesday and Seventeenth day of Same Month Anno Dom. Seventeen hundred and thirty one for the appearance of the Same John Inch to this Court being the third tuesday of November and Sixteenth day of Said Month Anno Dom. Seventeen hundred thirty and one And now at the Same day last mentioned came the afd John and in his proper person appears to the afd Recognizance and prays that he and his Suretys afd may be disch.d Ordered by the Court here that the Same Recognizance be Disch.d as prayd The afd John Inch his Recognizances afd |
